Interesting information regarding huge delays in I-130 processing

Hi guys,

I don't usually post much on forums but last month I submitted my I-130 application and I have been reading in horror about the 12 month wait times that we have been told to expect. So I did some research and came up with some articles regarding the new processing facilities in Overland Park, MO. It looks like most of our I-130 applications have been going straight to the NBC (either Overland Park or Lee's Summit). It also looks like basically none of the applications that have gone to the NBC in the past months have been approved. The only ones being approved are the ones that are going to the service centres (particularly Texas).

Here is an excerpt:

"The additional federal jobs coming to the metro are partly the result of the flood of applications prompted by President Barack Obama’s decision in June to allow young undocumented immigrants to stay in the U.S. without being deported. The CIS began accepting applications for the program in mid-August.

At the time, the Associated Press reported the new policy would lead to more than 1 million applications during its first year with about 890,000 people being immediately eligible."

It looks a lot like our applications are being left behind while they work on assisting people who have immigrated illegally. If this is the case, I really do not understand how they can allow an illegal immigrant's application to take precedence over the application of a paying US citizen who is petitioning for the right to bring his/her spouse into the country!

The new applications are called 'deferred action' applications (I-821D) in case anyone is interested.

The fact that these changes have come right from the top (i.e. Mr Obama) means that it is unlikely to change any time soon. So, anyone else have any thoughts on this? Short of writing to the USCIS, I am pretty much stumped.

Stevie b I sure hope you are right! I am hoping and praying that we will see a ton of approvals in October, trying not to freak out until then.

oh gosh a feb filer :( so sorry for that

again this is only an opinion and a guess based on what happened over the last year with daca mess

the new facility will start approving petitions they have on file.. this will mean you will see a flood of the may-june filers go through

then the local office transfers will begin unless your file is on a desk already. these files will transfer to the new facility and get processed for approval.

have you gone for an infopass or anything? you are really overdue

Shoot! I just realized my timeline says Feb (I will fix that), should be received March 28, NOA1 on April 5. No, I have not called yet or done an info pass. Plus, my application should be staying at the NBC as we are filing from Canada. I say "should" as from what I can tell it could still be sent god knows where. From what I have seen no one is getting any info on their cases right now when they call. Do you think there is any point trying? Any advice would be great, I am so lost and so pissed.

well I am sure you already know that dcf was supposed to be fast. I have seen quite a few dcf's that for whatever reason have slowed considerably.

I believe that at the six month mark you can start a service request but sometimes they give you a hard time about that one. best to do this with an IO rather than a CSR.. the IO may be able to give you an update.. but again maybe not... no saying that to get you any more riled than you already are ;)

well I am sure you already know that dcf was supposed to be fast. I have seen quite a few dcf's that for whatever reason have slowed considerably.

This isn't anything new. I knew about this when my I-129f was still in processing. The deferred action processing started in August, 2012. I was told around January, 2013 that all of the deferred action applications were going through CSC which was delaying the i-129f's. It sounds like it's only gotten worse since then. :(

I really hope that everyone is having to wait for their fair turn, but it doesn't sound like it's like this at all still.

But now they can be legal in the country in which they were raised. Based on what happened in Washington, DC at the Navy Yard today, I don't think crime is limited to illegal immigrants.

I assume that when Division XIII at Overland Park becomes operational (sometime before the end of September) we'll see some movement. Division XIII will handle stand-alone I-130s ONLY - so hopefully that will streamline the process. Those of you with I-130s with other forms, or doing DCF will go through another processing center.

While I am impatient too, I find it hard to get upset at an illegal immigrant whose parents brought him or her here as a child. It's not like they had a choice. But now they can be legal in the country in which they were raised. Based on what happened in Washington, DC at the Navy Yard today, I don't think crime is limited to illegal immigrants.

I assume that when Division XIII at Overland Park becomes operational (sometime before the end of September) we'll see some movement. Division XIII will handle stand-alone I-130s ONLY - so hopefully that will streamline the process. Those of you with I-130s with other forms, or doing DCF will go through another processing center.
