ROC: abuse or divorce?

Hi everyone,

I have a situation: I couldn't take the maltreatment from my USC husband any more. The marriage was short, around 17 months old, but every day was a battle for me. So I asked for a divorce and he filed and then kicked me out that night.

I need to remove the condition off my conditional greencard. I don't want to claim abuse. I am physically and emotionally and psychologically drained out so I would like to put all the memory of the unhappy marriage behind and move forward. I mean I would like to not go the abuse route if I didn't have to.

So I wonder if I can just file for removal of condition as divorced instead of abused.

Please give your opinions.

yes you can , you just need to submit proof of bonafide marriage, you have to proof you had commingling finances(joint bank statement,tax return filed jointly etc..) and commune residence(utilities bills in name of both, lease agreement in name of both etc...)

It would be much faster and easier to file to remove conditions as divorced. You would need to show you entered the marriage in good faith.

@Dear Sandra: I thought a lot about the advice you gave (in a private message). But just thinking of the past makes me scared and feel suicidal. And in order to prove abuse I would need to do more than just recalling what happened. I don't know if I had the strength for that. So I'm going the other route.
