Looking for approved AOS applicants from Russia

Hello all,

I have heard that the FBI name checks for AOS applicants from Russia seem to take a long time. Can some of those who have been approved share their experiences? We are currently in the midst of the AOS process. Thanks!

K1 Journey:

2/07/06 I-129F sent

2/13/06 NOA1

2/28/06 NOA2

5/12/06 Boris's interview in Moscow

5/19/06 Visa in hand!

5/22/06 Boris arrives in Washington D.C.

8/06/06 MARRIED!!!

AOS Journey:

11/28/06 AOS, AP, and EAD mailed

12/04/06 NOA1 for all applications

12/07/06 All applications touched

12/09/06 Biometrics appointment letter received

12/11/06 All applications touched

12/13/06 EAD & AP touched

12/15/06 Biometrics in Norfolk, VA (very simple, took 30 min.)

2/01/07 FBI info line confirms biometrics were received and returned 12/15

2/07/07 EAD and AP touched, AP approved

2/08/07 EAD and AP touched

2/12/07 EAD approved; card production ordered

2/12/07 Interview notice received

2/13/07 EAD touched

2/16/07 EAD received

2/17/07 AP received

4/30/07 AOS Interview--APPROVED!

5/07/07 Welcome notice received

4/02/09 I-751 sent to VSC

4/06/09 Package received @ VSC

Hard to predict. You won't know until after your biometrics appointment, at the interview. Since that will be ~4 months from now, chances are it will be done by then.

We are filing a new AOS next week, hopefully all of that will still be in Galina's file. I doubt it will make things faster though.

Good luck! (I wouldn't worry about it much - there is nothing you can do now). Once you have the EAD and AP, it really doesn't matter how long they take.

My wife's was done by the time she had her interview. At the AOS interview, she was approved, her passport stamped, and there was no additional holdup. She got the PR card in the mail a week later.

PEOPLE: READ THE APPLICATION FORM INSTRUCTIONS!!!! They have a lot of good information in them! Most of the questions I see on VJ are clearly addressed by the form instructions. Give them a read!! If you are unable to understand the form instructions, I highly recommend hiring someone who does to help you with the process. Our process, from K-1 to Citizenship and U.S. Passport is completed. Good luck with your process.

Timeline

I had to wait for 5 months AFTER the interview for my background check to be complete and the green card issued. Still, it's only 10 months after we sent out the AOS documents, which is not too bad.

We think that there is a strong chance that we will get a CSC transfer...we seem to fit the criteria. So, we may not be waiting months for an interview. But I guess we could be waiting months for the name check once it gets to the CSC.

Still, it's only 10 months after we sent out the AOS documents, which is not too bad.
Ugh, that sucks ###. For us, total time between mailing in the AOS papers and having PR card in hand was 4 months.

It just goes to show that due to the immense variability in processing times, that the experience of others is largely irrelevant to your situation. You just don't know what they will do.

February 3, 2005. Applied for K-1.

July 14, 2005. Email to NVC congressional unit

Nov 2, 2005. Letter to congressman

Nov 8, 2005. Letter from congressman

December 19, 2005. Visa interview in Moscow. (250 days at NVC)

January 27, 2006. POE: JFK.

April 8, 2006. Wedding in USA.

April 19, 2006. Apply for AOS.

July 12, 2006. AOS Interview.

February 26, 2008. Letter to congresswoman.

March 19, 2008. Conditional Permanent residence began!!

2009: Wake up and get on the uscis train again - lifting conditions

Dec 21, 2009. Eligible to apply to remove conditions

February 2010: 10-yr Green Card Received

My husband had his interview April 2005 and the FBI name check is still pending. I have known several Russians to be approved within 6 months of filing AOS without any problems so you have a chance :).

For everybody not intimately involved with FBI it should really look like a game of chance... We were transfered to CSC and got GC in 2.5 month without interview.... do we have to blame it a rare last name? who knows

Five and a half months since we applied for AOS and no transfer and no date for an interview. I'll be patient for a few more weeks.....

I still think that 10 months is not TOO bad. I did not expect to receive my GC in less than a year. ;)

Let me just add a few more questions on here.....

Elena's K-1 expires in mid-January. We're going to get married today, and hopefully file all AOS stuff over the weekend or early next week.

What documents do we need to file?

What is the actual ID the K-1 beneficiary can use once they have filed for AOS, etc.? If the K-1 visa expires in January, her state ID expires too, her visa in her passport is expired...... how does that work? Do you just carry copies of the AOS paperwork along with the passport/visa?

Is it possible for the beneficiary to work after expiration of the K-1 and prior to issuance of EAD? (Same as AOS... carry around the paperwork and "old" authorization?)

Just clue me in on the whole process. Thanks in advance.

There is no legal way to work until you have the EAD. You should get it about a month after biometrics are done, so plan on about 90-120 days from filing.

You will recieve a I-797 Notice of Action within a few days of filing for the AOS. This is proof of permission to be in the US. Carry a photocopy if you are worried. Until the GC is approved, this will be the only proof you have. Here (in FL), it is enough to get a drivers license.
