Hello,

I wish I was posting another question on how to file and whatnot, but am not. I am the USC and have not sent in the AOS paperwork, after being married to comply with the K1 requirements. I purchased her, the bene, a return tkt back to her country as we decided. Apparently, and I won't know until tomorrow, she did not leave. I do not want to be responsible for any of her doings or actions from today forward since she is not with me and will not return. Since I have not sent in the AOS package, what do I do to ensure the USCIS or whomever knows she is MIA and without me?

The I-134 expires when the I-94 expires, so yer off the hook for any financial responsibility.

Makes me wonder how Mcat is doing.....Be careful of her if she tries to return. After she finds out she can't obtain a green card without you she may come back all tears and sorrys and try to patch things up. I'm not saying she would be insincere but I would question her motives very strongly.

you need to not walk but run to the nearest immigration office and give them a written statement that you are withdrawing the affidavit of support you submitted and you that you are seeking anullment of the marriage as she has left.

Unfortunately it appears you are a victim of visa marriage fraud. You are not alone in this, there have been many people who have suffered this.

Additionally prepare yourself for the possibility that she is going to claim you abused her. You need to be prepared for the worse as she likely wants to stay here and will say anything in order to do it. I have seen it happen before and there others here who have suffered the same.

There's no Affidavit of Support to withdraw. They haven't filed yet. So he is safe there.

Contact USCIS, and contact ICE letting them know that she left the marital home and you are not continuing with the process.

As you are married you need to protect yourself from a fake VAWA claim. NEVER be alone with her.

I just want to protect myself, since I was the USC that brought her here. I have contacted a lawyer to work with me on this. Her family and she may try to put false charges against me and find a way to stay here. I just want her to go home and protect myself, that is the bottom line so I am just asking what others have done in a similar situation to know, but in the end the lawyer will figure it out I suppose.

She told me soo many times how she'd rather be back in Peru and now that I paid for her tkt bk, she did not leave...ummmhh To me it looks and feels like I was being used.
