Omg.. Couldn't even think that would happen. I got my notice of GC extension in April. In July me, my husband ( us citizen ) and our daughter ( us citizen) all went to Russia( where I am from). My husband spent 3 weeks here then went back to us to work. We supposed to come back in 2weeks. In August he received a letter for my biometrics appointment for August 25. He called them, sent them letter with form for rescheduling the appointment for me, went to our local office where the fingerprints taken , they say it will be fine , I'd they got letter before the date of bio appointment . The letter he sent ,arrived to Uscis office August 21.

Yesterday he got notice , that my i751 was denied and terminated because of failure to come to biometric appointment!!! Why???? If he requested reschedule it ??!!!

Now I'm with our daughter are in Russia, he is there in USA . I'm about to cry , having no clue what to do...

I guess if we go back , we just be turned back to Russia ..

Please help with any advices !!!

You need to phone the US and explain that it was denied in error because of a mistake about rescheduling. Go through all the time ticks for rescheduling correspondence. Get them to reopen the case.

I am not sure that your husband was able to legally reschedule for you, though. You needed to do that yourself as the applicant.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

Filed: Citizen (apr) Country: Tunisia

your husband needs to go back to USCIS and request to reschedule the biometrics since he sent back the letter. He should probably call your congressman and ask for help as well. If necessary get a lawyer involved to do all of that.

One question please:

Why would you travel when you know you just applied for ROC and you have biometrics? why youldn't you wait until you at least get done with biometrics?

I'm not trying to give you a hard time but now you are stuck in Russia until the ROC problem gets fixed. I'm sorry for what happened to you and I wish you luck.
