I just need some clarifications in regards to my sister's visa application. My sister and kids had their interview last August 26 2013. The CO that my sister last spoke with said that all they just had to do is to verify her CENOMAR and NBI. Well last Wednesday we emailed the USEM Manila and told us that they needed more information from the NBI because my sister's record indicates indicates information that could adversely affect her eligibility for a visa. So as a sister, I started panicking and called my sister immediately. She told me that it was because of a BP22 filed against her but was dismissed because both parties at that time came to an agreement. So now we are just waiting to hear from the embassy and what the next steps to do. Will my sister be ineligible for an immigrant visa because of this? This will greatly devastate my whole familycray5ol.gifcray5ol.gifcray5ol.gif . My sister has 4 kids that will also be affected because their her derivatives in the application. The rest of our family are already here in the US except for her. If she gets denied will she be eligible for a waiver? For those of you, that maybe has gone through the same thing or has knowledge about this situation kindly respond to my post. Any info's will be greatly appreciated.

What was indicated on her NBI clearance?

Did she submit proof (court records) that her case was dismissed?

They didnt really say what they found when they verified her NBI but my sister said all she could think of was her BP22 case. When she went to get her NBI they asked for her court documents before they could release her clearance which she did.

My sister took it upon herself not to submit her court documents during the interview and the CO never asked for it. I did not know she didnt submit it until now. When I emailed the USEM I asked them if we need to submit any documents and they just responded that we should wait until they're done with verification the CO has reviewed it.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

UPDATE: The USEM sent us an email stating that my sister had to go to NBI and do an interview and get a letter of explanation in regards to the resolution of her case. My sister got it done within a week after we got the email.

Oct 7 2013; we got another email from the USEM that visas were issued on that day for my sister and her children. We are just beyond happy and so grateful with the outcome. It was a stressful time for our family and now we are just relieved and elated. Now my sister is just waiting for the visas to be delivered which we hope won't take too long. I think we all have waited enough for this petition. It has been 11 years since the petition was filed by my mother.
