Philippine Fiance In Japan

I have a Philippine fiancé living in Japan. We are going for K-1 VISA and she just received a letter from the embassy in Tokyo. One of the requirements is a CENOMAR,, but the copy she has is dated back in 2008. She has Japanese divorce decree and a document from the Philippine Embassy (Certificate of Acceptance of Notification of Divorce) where it states on the bottom of the letter "" This certification shall be forwarded to the National Statistics Office, Manila Philippines, through the department of foreign affairs for proper recording and notation on their marriage certificate/report of marriage." and Dated June 2007. Do you see any legal complications sending the documents my fiancé has and getting a new CENOMAR maybe showing she is married? Are we Ok or do we have to start stressing :(. I am very confused.

I'm assuming you've been approved? She needs to get a CEMAR (Advisory of Marriages, valid for I think 6 months only) not CENOMAR since she was previously married. I'm not sure she could order it online and have it deliver in Japan. But since she'll be going back to the Philippines, I suggests she go to the nearest NSO office and acquire it but it needs to be with her during the interview.

If once approved and she wants to fly out of the Philippines to US, she's required to attend CFO counseling prior to departing. They will not let her leave without the sticker affixed to her passport with visa.

CENOMAR should not be more than 6 months old to make the embassy happy.

It appears that the divorce was recorded with NSO already the way I read that, so you don't need to send a copy of the divorce decree to NSO. You only need to order the CENOMAR from NSO.

It appears that it can take up to 8 weeks to get the CENOMAR when requesting from a foreign country.

I forgot to mention if/when the VISA is approved she wants to go to the Phils and visit family then come to the US. Would there be a problem with this?

This will create a new requirement when time to leave the Philippines again. ALL immigrants exiting the Philippines much have the CFO sticker in their passport. If you fiancée travels back to the Phils to visit family after getting her visa, she will not be allowed to exit again until she has the CFO sticker in her passport. There is CFO info in my link below this post.

They are K-1, will need the CENOMAR. Doing the VISA process in Japan before coming back to the Phils for a visit with family.

You said "getting a new CENOMAR to show she is married"... I hope you mean NOT married. In the PI, a CENOMAR proves a person is single, either because they never married, or because they married then got annulled. It wouldn't hurt to have a copy of her CAND available, but she shouldn't need that if it was filed with NSO already, otherwise they would still think she is married and will not issue a CENOMAR.

She is processing at the embassy in Japan, not sure what their instructions letter asks for, the police certificate requirement may be different for that embassy. Of course a police certificate would be pretty easy to acquire being she is currently living in Japan.

Thank you all for the answers. I have to ask about this Red Ribbon thing. Do the birth certificates need to have the red ribbon? The Tokyo Embassy is asking for originals, but do they have to have the red ribbon?

To answer DavenRoxy question.. she is not married. Maybe my bad choice of words explaining.

Yes, the CENOMAR has to be within six months. She can use old birth certificate as long as it was issued by the NSO and she doesn't need the Red Ribbon.

She also needs to provide police certificates from Japan and the Philippines (NBI Clearance). She can get the NBI Clearance from the Philippines Embassy in Tokyo. To get the police certificate from Japan, she has to apply at the Prefectural Police Headquarters and bring the following documents with her: passport, alien card, and a copy of her NOA2.

No you do not need the RED ribbon. Originals from NSO will have a stamped seal on them.. that is what you need.

You should be fine with the older birth certificates, as long as they are from NSO and not copies of their original form.

OK, my fiancé (in Japan) has not been able to go back to the Philippines to get CENOMAR/CEMAR changed through court proceedings, but she has a divorce decree and also a letter from the Philippine Embassy acknowledging divorce and will forward documents for adjustment to NSO. My question is with all divorce documents (Japanese & Philippine Embassy) will this be a problem with CFO?

When she goes to the Philippines, will she be going back to Japan? I currently live in Japan with my husband and visited Manila a few months ago

I took the CFO seminar just in case. But nobody checked at immigration. Prolly because i still had my maiden name on my passport (not my new foreign last name).

As for CFO ringing alarm bells at your girl's divorce decrees, I guess it all depends on the circumstances of the divorces and on details of how you met and how you had the relationship
