i am a us citizen and i wanted to petition my father so he could stay with us here but the problem is i am not sure if i could do that since i was looking at the application it was asking if he is married now and if he was married previously, if so when did it ended?

Here is the story, my father was married to his first wife for 5 years and had 2 kids together and after 5 years of living together one day the wife just left and not knowing where she went, my father looked for her but did not found her no communication at all she just left and even her kids does not know where she is since she did not even try to contact them. After few years he met my mom and married her after i was born and that was in 1983, years have passed and in 2011 my father found out the the first wife have died in 2010 and so now i wanted to petition him but i dont know what to put in the application form since both marriage are legal according to the records in NSO.

Without a valid marriage ( or with a questionable one ) expect to be asked for DNA to prove the relationship. Submit the required papers for your fathers petition and save a bit of money in case they request DNA if they don't then have a nice party when he arrives. As long as he is your bio father and that relationship has not been severed legally ( like someone adopted you ) you can petition him and successfully get it approved.

This will not be over quickly. You will not enjoy this.

July 29, 2013 - Approved NOA2 ( 82 working days)

July 30, 2013 - USCIS shipped my documents to NVC

Aug 5, 2013 - Arrived at NVC Building

Aug 13, 2013 - Got the NVC case # via PHONE

Aug 14, 2013 - Got the Invoice # via PHONE

Aug 15, 2013 - Send my DS-3032 via Email

Aug 16, 2013 - AOS Pay

Aug 17, 2013 - Got an email to print the COVER SHEET

Aug 21, 2013 - send the AOS overnight at NVC

Aug 28, 2013 - Accept the DS-3032

Aug 30, 2013 - IV BILL pay and Documents Sent to NVC receive the checklist AOS.

September 19, 2013 Sent back the checklist

September 20, 2013 Sept 26, arrived @ NVC

Sept 30,2013 - already encode to their system

CASE COMPLETE AS OF TODAY : OCTOBER 23,2013

thank you for your response but do you think they wont question my father since he married my mom in 1983 while the first wife death was only last 2010?


Wasn't there any divorce or anullment? How could he get married to his second wife, if his first marriage wasn't legally terminated?

there is no divorce or annulment in the philippines and at that time you can marry anyone because they dont check records.

Your father should filled out the forms for you , If you are really his child , he should give them, DNA test documents ( father and child). Also Your father should prove ,He was USA citizenship , when you was born.

who care your mom was real marry or no. But if your mom wants come in USA, she should prove her marriage with you father. That time he should prove " first marriage divorce or his wife death documents", and Second marriage document (with your mom) . Even your mom and your father married yesterday , Doesn't afect on your file.

who care your mom was real marry or no. But if your mom wants come in USA, she should prove her marriage with you father. Even your mom and your father married yesterday , Doesn't afect on your file.

Important : Your DNA test result should come from "The Laboratories trusted USA Embassy in your country." Then don't waste your money for other Laboratories.

I don't think this is a issue, since why should his father be a USC and file the forms, if the OP is filing for his father to come to the US and get a green card???

If the father is a USC he could just jump on a plane and come to the US with his US passport...

So if the marriage is valid, and you just present their marriage certificate, that should be it. The only problem that could occur is the CO questioning if the marriage between your biological parents is legal. Still you could file the I-130 for them since beeing married to each other I don't think is even necassry.

It's amazing how many questions can be resolved with a 2 minute Google search...
