Hello, all !

please, advise me with a couple of questions for AOS (K1and K2) forms :

1. in the end of G-325A (biographical) it asks for your name in a native alphabet - is it my maiden name or my married name now ? (i am not sure how my married name would spell in my native alphabet as there could be variations).

2. in G-325A for K2 it asks abt my kid's parents' "city and country of residence". As i am in USA now, do i indicate my residence in my country or in USA?

3. for travel permit it requires "explanatory letter" why we would need to travel (they show 3 reasons : humanitarian, educational and if i remember right - family emergency). First, is this letter really mandatory? and second - what if it is for a family but not like emergency? just too long to wait for AOS).

One more question as for I-765 (employment) : if one is married after K1 visa, and applying with the form I-765 within 90 days and together with I-485, what category should one indicate : a6 or c9 ? because it sounds totally confusing in the instruction:

6. Family based non-immigrant categories:

A. K-1 Nonimmigrant Fiancee of US Citizen ...- (a)(6)

File form I-765 if you are filing within 90 days from the date of entry. This EAD cannot be renewed. Any EAD application other than for a replacement must be based on your pending application for adjustment under ©(9).

7. EAD Applicants who have filed for adjustment of status.

A. Adjustment applicant - ©(9). File form I-765 with a copy of the receipt notice or other evidence that your Form I-485 is pending. You may file Form I-765 together with your Form I-485.

Totally confusing - what is the difference then and what to indicate?

C9 is correct.

As I understand it (and please all others correct me if I am wrong), category A6 would for an EAD that you COULD use to work while your I-94 is valid. Doesn't make sense though because the I-94 expires after 90 days and processing times for the EAD are running at 2-3 months currently. So you would be paying 300-something dollars for something you could only use for a couple of weeks.

PS: For your first questions, I cannot help with 1. and 2. But as for 3., you don't have to write an explanation letter.

Thank you as for I-765, we almost filed as a6, but after your reply i will probably call USCIS and try there if they are willing to explain. I will post here if any info from them.

Read Carefully, interpret literally.

1. It asks for your native alphabet IF OTHER THAN THE ROMAN ALPHABET. If you changed your name, your name is now written in the Roman Alphabet. The reason this is done is because different people will transliterate a name differently from another alphabet (Tatyana, Tatiana for example)

Since you are now HERE and your new name uses the ROMAN Alphabet it is no longer applicable. You can leave it blank. If you even try to write it using the Cyrillic alphabet it is simply YOUR reverse transliteration and is likely to be more confusing than anything.

2. USA

3. Not necessary for a K-1/K-2 The travel form is used for several classes of travel permit. You are not applying for a "travel permit" you are applying for an "Advanced Parole" The question is "NA" for your purpose.
