Hi, I am new to the VISA issues. Here is our situation:

1. she obtained the B2 visa in August. she has never entered the U.S.

2. I (an LPR) went back to China few couple of weeks ago and we got married.

3. I returned to the U.S. a few days ago and sent the I-130 petition to the Chicago Lockbox (by USPS express mail). we indicated consular processing in the I-130 form.

4. She plan to visit the U.S. (visit me and also sight-seeing) in October or November. At that time, the I-130 will be pending.

My question is: Will she be denied of entry at the Port of Entry since her visa is B2 but she also has an I-130 pending? What are the risks?

what should I do?

In case she is denied entry at Port of Entry, will that pose any negative consequences of her I-130 petition and the following consular processing?

Hi,

Anyone can be denied entry as you know of course!

but i had the same situation and entered the US 3 times on my B2 visa, i also renewed it after applying my i130

October 1, 2013 - NVC emailed notice of receiving DS-261
October 2, 2013 - Received IV bill
October 2, 2013 - Paid IV bill
October 5, 2013 - Payment Approved
October 6, 2013 - DS-260 submitted online
October 8, 2013 - I-864 and IV supporting documents sent to NVC via snail mail
October 10, 2013 - AOS package entered into system for review
October 11, 2013 - Civil documents entered into system for review
November 6, 2013 - Checklist for AOS received via email
November 12, 2013 - Checklist Response sent via snail mail
November 14, 2013 - AOS checklist response entered into system for review
December 10, 2013 - Case Complete email received
Awaiting interview letter ClockWatch2.gif Praying for February interview :)
