Hello guys,

I need you guys to advise me on the two options before me and my woman. September last yr she filed a K1 visa for me but it was denied because we hadn't met in 2 years at that time however my woman is visiting this month hence we are crossed btw getting married and filling the spouse visa or to still go with d K1 visa cos of the previous filling.

I ll appreciate ur kind advice.

IMO.. I would get married and file for a cr1

you are coming from a high fraud country and want the added security of this for a better chance at success

if you are married you would not be able to file the 129 anyway

Think of it this way. You are a CO and you have a couple wh have been together and have two kids together and still not married. To a CO may show lack of commitment.

This is Nigeria you are dealing and whether K1 or CE1/IR1 you have to show a bonafide relationship.

Okay i am confused you haven't meet but you have two kids together? Did I miss something?

Slightly confused by your statement. Have you met in the past and had kids but then you two did not see each other for two years at the time of filing the K1? If you have kids, then you must of met sometime in the past???

In any case, if you file a CR1 after getting married you have a better chance of moving forward and a possibility of approval. This doesn't guarantee your petition will be granted a visa when you face the CO, but at least if the petition is returned you can reaffirm verses K1 which is returned is expired and dies.

It is your choice to refile the K1 or marry and file CR1. Either way, you will need to show that you have an ongoing relationship and proof that you are in this relationship for the right reasons. Having children together doesn't guarantee that you will get a visa. Few visits by your spouse/fiancee is necessary before you face the CO.

We have been lovers since 2003, she won the usa visa lottery in 2005 and then we were having issues so I decided not to have her add my name to her docs however we settled it, had our traditional wedding in 2007 and our son came later that year (we had him in md). She came back to Nigeria and went back to usa in 2008 pregnant with our daughter. I lost my job soon after and wasn't able to fund my family visit to Nigeria. That's d story, am not so good @ story telling but I hope u understand now.

However we have agreed to do our court wedding once n for all.

Thanks for clearing things up. We are not trying to be in your business, we are trying to help you make the right choices, that is why we ask the vital questions, so we can make the right suggestions.

YOU are way passed filing for another K1. YOUR best bet is getting married at the registry and filing for CR1. You have had a traditional wedding that by itself is a denial if you file another K1. They will tell you, you filed for the wrong petition and ask your wife to go and file for spouse. Any traditional wedding is considered a marriage in the CO's eyes.

Also, you have had children with one another. You are a family now. Best thing to do is have her come to Nigeria, do the registry wedding with your children present and family with friends. Take lots of pictures for later to be sent in with petition and NVC.

You will be asked to have a paternity test on your children at some point in your process. So be ready for that as well. Meanwhile, Once married, your wife can come back and file for your CR1 petition and depending on the time frame right now, this might take anywhere from 8months to a year or so.

Frond load your petition with a lot of evidence, letters from family and friends that you have a bonafide relationship and that it has been ongoing for years. I hope you have not lived or taken a second wife while you were apart. This will complicate things for your petition.

You were denied for the 2 year requirement not for lack of validity of the relationship. You seem to have a ton of evidence of a relationship you just got caught with an administrative requirement. So you should be successful filing either a K1 or a CR1 The question is do you want to celebrate your wedding in your home country or your new one. Make that decision with your hearts and stick to it.

This will not be over quickly. You will not enjoy this.

Whether you decide to do K1 or CR1 is your choice. In the past when people were interviewed and had any pictures of them in a traditional ceremony and they had filed for a K1 they were denied visa and were asked to go back and file a CR1 instead. They were told that they were married due to the traditional ceremony whether it was engagement or a traditional wedding.

Based on the past posts here on VJ and you can research it yourself, there were denials by CO in situations which involved ceremonies. If you file a K1, you chance getting denied and if petition is returned to the US, it will not be open to be reaffirmed. If you file a CR1, then if you get denied at the embassy (God forbid) you have a chance to reaffirm your petition when it is returned here in the USA. Since, you are planning to marry anyway, I think you are on the right track...yes.gif
