Only six months, not even divorced, and he is talking remarriage? How about trying to work it out first. If they can't work it out then file for a divorce, then after healing then talk about remarriage.

depending on where he is with his AOS if at all... depends on whether the govt will let him stay!

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

In fairness to the OP, if their friend came in on a K3, then they've been married for longer than six months. They had to get married before they could even apply for the K3.

Is the OP asking this as a hypothetical or does their friend already have a replacement spouse in mind?

If he's not married and over 18, I don't see why your friend shouldn't be able to remarry. I don't think the US has any laws about the number of times a person can be married or how much time needs to pass between divorce and remarriage.

My friend came here on k-3 visa about six months ago but things are going the wrong direction between him and his wife and it is not his fault.my question is that could my friend remarry here in US after the divorce became final?

K visa types have specific requirements in terms of the ability to adjust status. Where is your friend in the process?

Sure, this "friend" could re-marry, but his ability and eligibility to adjust status is based on the existing K3 visa and marriage to the current spouse. The current spouse is still tied to him through the affidavit of support even after divorce, until he leaves the country permanently, or he can be credited with 40 work quarters, or 10 years, whichever comes first.

Getting divorced and then marrying another USC will not necessarily mean that he can stay in the US.

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card
