Hi all,

I have been using this site for a while, but I rarely have a question that can't be answered by using the search function. Now, though, I do have one that I cannot find on the forum:

I filed the I-751 for my wife on August 30th, sending her package to the Vermont Service Center in St. Albans. According to USPS tracking, it was delivered on September 3rd. For my wife's original green card filing (I-485, etc) USCIS cashed the check and sent us an e-mail within a week of sending the package. This time, though, we are coming up on two weeks and the check has not been cashed, the return receipt has not been sent back to our mailbox, and we obviously have not received our NOA yet.

If I had sent it three months before my wife's green card expired, I would be fine. But my wife's green card expires on September 22nd. Is this kind of thing normal or is it time for us to re-send the package before her card expires? I am just concerned that if they didn't receive the package, that it will be too late to re-send it after my wife's card expires. What happens in cases like that?

Are they just too backed up around Labor Day?

Yes backed up - Mine was recorded on the 26th August and Check only cashed yesterday. I was also transferredto CSC. Many VSC late August and early Sept still have had no notification - hang tight, its coming. My GC is also expiring on the same date and still not got my letter of extension. Its on its way though im sure. Do not re send the package....yet.

Lucy NY said it right... VSC is overwhelmed and they're currently backed up.

They even transferred many of the June filers to CSC for processing...

Once they get to your application, they'll send you an NOA which will extend your wife's GC for a year.

Definitely no need to resend the package.

Most of the August cases are being moved to a Local Center in Vermont (those that got NOA1 can call 1-800-375-5283 and select the options for case status and it gives the details - no need to get a person) or CSC. My guess is that your cases are being transferred before the NOA1 issue - our cases were transferred after NOA1 issue.

Be patient and you should be fine.

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

The parts that are most concerning (and your answers border on this) to me are that 1.) I never received the return receipt which, I thought, is returned right after it is delivered regardless if they reviewed anything yet, and 2.) that they never cashed any check yet, which would be acceptable proof to show USCIS in the future that I sent the package on time.

Without either of these, I can say that I have everything on time, but there is no proof.

It took them a month to cash my check and send the NOA1 last year. Don't panic. They ask for 30 days to cash the check. Your NOA1 will be backdated from the day they received the package.
