USCIS approved my waiver request. Please read my previous post. As I promised here is my update and approval.

In the past 2 years I had two approved K1 applications and cancelled them prior to interviews….don't ask, big mistakes! :crying: Partly because I am a nice guy and always look for the good in people, :innocent: but some people do not play by the same rules. So I learn…..and live. This was my third attempt at it and I know it will stick!. Also, my lady had come to the US on a K1 visa at the end 0f 2004 with someone else and she was also mislead, so within 2 weeks headed back home. Talking about the odds stacked against us for the USCIS!!! :o The new IMBRA laws came into effect right after I met my lady Svetlana but I knew this was the right person for me! Perhaps my prior failures were meant to be. I tried to use the same lawyer I had used before (well known in the K1 field) for my waiver request but he wanted no part of it. I guess they are only interested in the easy money. :angry: Another attorney was very helpful but still would not take the case….now I DO believe this is how they get their 100% approval rate !

<>With the info I had received from a couple of our VJ'rs I was able to compose my own request. Documented the process to date, applied my own twist and submitted the application "Pro Se". A couple of things that helped me a lot were: <>

1) Once my other relations ended, I engaged these ladies in an email discovery of what was in their mind and why they acted the way they did. Trust me, information started pouring out without them giving it thought and the truth comes out. This in itself is good news because what you suspected is now documentation that their intentions were not sincere. If USCIS asks for proof, now you have it.

I learn quickly.

2) Put together your K1 package as complete as possible and as professional as you can make it. I used the "Exhibit" format just as an attorney would use in court papers, including tabs outlining each section of the K1 package and believe me, mine was thick. Even though criminal background did not apply to me, I still included an affidavit. I even have my own police clearances that I will take with me for the interview….just in case. In the waiver request make a strong case for yourself and then have someone else proof read it for items you might have missed. A second pair of eyes

About 66 days after I received my NOA1, without any further touches or notice, I received several emails (NOA2) all at once that my petition was approve on Dec 7th. I knew it was getting close to the do or die time but I never expected this and without any RFE's!!!! <>

I hope this helps some of you, or at least gives you hope. I suggest you read the posts and sample waiver letter fellow VJ'r Robhankins has posted. I will post my progress as time permits. Good luck to all B)

Congratulations. This process is scary enough without the waver situation thrown in. I will be applying for my K-1 with waver in the next few days and found your post encouraging. My situation is just less than two years since my last K-1 with someone else.

Today and tommorrow I will be working on the wording for my waver request. I hope mine goes as smoothly.

12/14/2006 Applied for K-1 with request for Waver for Multiple filings within 2 years.

3/6 Called NVC file sent to Washington for "Administrative Review" Told to call back every few weeks. 7/6 Called NVC, A/R is finished, case on way to Moscow. YAHOO!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
7/13 On Friday the 13th we see updated Moscow website with our interview on 9/11 (Hope we are not supersticious) 9/11 Visa Approved. Yahoo.
10/12 Tickets for her to America. I am flying to JFK to meet her there. 12/15/07 We are married. One year and a day after filling original K-1
12/27 Filed for AOS, EAD & AP 1/3 Received all three NOA-1's 1/22 Biometrics 2/27 EAD & AP received 4/12 Interview
5/19/08 RFE for physical that she should not have needed. 5/28 New physical ($ 250.00 wasted) 6/23 Green Card received
4/22/10 Filed for Removal of Contitions. 6/25 10 Year Green Card received Nov, 2014 Citizenship ceremony. Our journey is complete.

Congratulations. That is fantastic news. I'm sure you are so relieved and happy. Looks like you will be visiting Moldova this winter with a happy heart and great anticipation.

Bump...

Any other "Waiver" Approvals??? I sent my packet last month, received NOA1 from VSC. I am praying we get an approval. I'll keep every posted. Just wondering if anyone else got their waivers approved?

I know VSC is pretty quick, so wondering if the waiver will "slow" us down any.

by the way my first K1 was approved June 2005 (for my ex)

Vermont approved my K-1 with waver without a problem. It did take 5 weeks which seems slower then most Vermont filers and I am assuming the waver request was the slow down. You can see my timeline or signature which both show the timing on it. When I have more time which won't be for a few weeks I will post a copy of my waver request in case it helps anyone.

It's really great to hear about so many successful waivers. Congratulations to everyone. Your success is paving the way for others.

I know some are out there, unsure if they can get it done. Well it is working, you just need to be complete, concise, truthful and provide good detail.

Turboguy congrats!!!! and thank you for sharing. I was so worried because our NOA1 came in on 2/2 and usually after a week with no touches you get your NOA2 from VSC - they're quick. When I didn't get touched or get the approval this week I was nervous. Then I thought maybe it's the waiver, because I think that has to be approved separately first. So now I know not to panic. I just hope it's approved, by the end of the month. If not, we are planning to get married when I leave to go back for a visit March 30th.
