Section 221G?? Anyone Got this? Please help :( So close yet so far

My fiance' finished his interview on September 10th, 2013. Unfortunately, they kept his passport and sent him this email in order to get approve. Other than that, everything went well just the fact that they didnt accept our co-sponsor but he didnt have enough time with them to explain why my income was low last year. Due to college as well as being a full time and graduated May 2013. I was just a part time and didnt earn enough to meet the poverty guideline. So, I took my both my parents since they are joint it was around 56k with 6 people dependent including themselves. Making me and my fiancé 8th all together. I guess they didnt accept it and want my own income.


I provided my pay stubs and all our w2 form and ITR 2010,11 and 2012. And as well as employee verification.


We are just hoping to send them my new paystubs and an explanation that I was a student including my classes and my degree.


Can anybody explain if this would work or if you guys have any other ideas what should we do. We are so close yet so far. :( I cried thinking what is this happening now when everything was just going to plan But i guess God has His perfect time.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I feel for you and I understand the frustrations and stress that you are going through at this moment. I am of no experience on your case or 221g itself... Things I can tell you right now are just base on my own perception on the things regarding your situation...

Basically, on K1 visa specially here in the PI, the embassy doesnt accept co-sponsorship... But.... You can hear alot that have been granted a visa or approved using co-sonsorship. And becoz of this, we can't really say an exact answer if somebody ask if it's ok to go ahead on getting a K1 visa using a co-sponsorship. It leads us in a limbo most of the time... In short... We don't know...

If my conclusion is right, those who were approved using co-sponship have been able to demonstrate their capability to support their fiance/e eventhough they are on bellow poverty level at the time of the interview. Maybe, they have given enough documentations regarding their capability...in example, they have assets (house, car, insurance, etc.), they might have a bellow poverty level tax return from the previous year becoz of some reason but their current job pays well this time, or maybe they have professions and experiences which can be their asset too in finding a better paying job in the future...It's all about demonstration of your capability... And the CO concludes that their co-sponsorship will only for a short period of time and definitely the one you are petitioning will not be a public charge in the future so they approve!

If you will ask me... Forget about being stressed regarding this matter... It happen's ... All you have to do is to strengthen where you are weak at! At this point it is your income that doesn't do well... Add hours of work, find another job if you have to and do it right now, gain work expeiences in your field of study since u said you just graduated.. Well, u have one year to comply with 221g (correct me vj member if i am wrong)... Work hard so your next year's ITR will reflect a satisfactory income! Go girl! U can do it! You've waited few months to be in this position right now and i believe you can wait some more! And you gonna do this coz u want to be with your love! There's a sweet pay in every hard work you will do now... No worries...

Here in VJ, we talk by experience and we help as much as we can... But most of the time OP has all the key!

Kaya mo yan sis! Focus lang and stress no more... Dyan lang yung visa... You just have to complete ur docs... You have time to do it... ;)

You need to have your fiancé submit several of your current paycheck stubs along with a letter from you explaining that you are a fresh grad and that your 2013 current sustained income puts you on a trajectory to surpass 125% of the poverty guidelines.

You are the second one in the last copy days where income was inadequate and the co-sponsor was not accepted. USEM is known for being difficult about accepting a co-sponsor with the K-1. The embassy is giving you one year to comply with their request to show sustained income that meets or exceeds the poverty guidelines.

Other option is to go the spousal visa (IR/CR-1) route, get married in the Phils then start a new petition. Embassy has to accept a co-sponsor with the spousal visa.

I would also submit an I-864 from your joint sponsor, as well as your joint sponsor's 2012 income tax return, and their current paycheck stubs.

we are still in the process we got a new co-sponsors that is making 47k a year with no dependent and i am working two jobs making at least 1300 a month and more so hopefully those works i will be send my paystubs since i just started it will be just two months or less so waiting for october to send it all or by the end of this month and hopefully they will send it soon. We also wrote a letter like you said and made sure to explain it. As well as attached my diploma and printed my classes during those times :) Thank you for everything just pray for us that hopefully everything will still go smoothly if not we will get married for sure in the philippines :)

August 15, 2013 - got my NBI ( total processing time from step 1 to releasing 1 1/2hrs)
August 23,2013 - CFO Attended, Got GCC. Sticker to follow.
