My fiance and I live in Bermuda. I am a USC and she is a Philippine citizen. We will be married in March.

I have been researching how to file for a spouse visa if the usc lives abroad and can't find an exact answer on what documents i need to fill out.

I have read about filing the i-130 with the accompanying 325 etc.

I do not have a domicile in the US. I have lived in Bermuda for 3 years, my fiance has lived in Bermuda for 5 years.

the i-864 however is confusing me. the instructions say

"3. You intend in good faith to reestablish your domicile in the US no later than the date of the intending immigrant's admission or adjustment of status.

You must submit proof that you have taken concrete steps to establish that you will be domiciled in the US at a time no later than the date of the intending immigrant's admission or adjustment of status. Concrete steps might include accepting a job in the US, signing a lease or purchasing a residence in the US, or registering children in US schools. Please attach proof of the steps you have taken to establish domicile as described above."

We plan on moving to the US together after the paperwork is complete and she can legally enter. We are both nurses, and we both have US nursing licenses that we have kept up. We don't have children. Where do I write this down on the form? Is there a separate form I have to fill out explaining that I live abroad? Since we don't know when the paperwork will be complete, we don't have an exact date when "the intending immigrant's admission" will be. We don't want to lease an apartment for a year for no reason while we live in Bermuda.

any help would be appreciated

Your first steps will be to fill out the I-130 for your spouse and send it to the Chicago Lockbox. The filing instructions aren't different from filing abroad.

You need not worry about the I-864 right now as you will have much time to look into that while waiting for your petition to be approved. You should consider establishing domicile in the U.S. or filing using the address of a parent or very close relative at home as this is sometimes necessary when getting immersed back into the U.S.

You don't need to include all these other details unless the I-130 questions ask for such information. Respond to the questions, include whatever forms the instructions require and some bonafide evidence. Check the example forms link under the VJ header and that should help a lot.

A lot of these things, the small details, you might discuss with a consular officer when the time comes. Just gather your evidence in the meantime and when your wedding happens, add those photos as well!

while you are right about not worrying about the 864 for now, telling the op that these things are small details and might discuss them with the consular officer is not the correct information to give out.

the OP needs to understand and have a game plan for domicile or as we call it here on vj establishing intent to domicile as well as the financial supporting needs
