Hello everyone!

This forum helped us get our K-1 approved, and now we need help with the AOS.

On form I-131, I'm not sure whether to mark Reentry permit or Advanced Parole, or both.

My wife and I are, of course, married, and together in the USA.

Advanced Parole seems to be for NON-permanent citizens outside the US.

and Reentry for PERMANENT citizens in the US.

My wife will be a permanent citizen once the i-485 is approved..so should I mark reentry? So confused!

Thanks guys!

Do you remember how you responded to the question asking "what qualifies you for advanced parole.." ?? Should I just put that my wife has a pending i485 visa? Also, what documentation should I include? I am sending this with the i-485, does that change anything (except the price)

I assembled my own AOS package and may have over-included documentation (rather safe than sorry) and I included a letter with mine, I've copy and pasted it below.

To whom it may concern,

I, (name), am filing Form I-131, Application for Travel Document (Advance Parole Document) concurrently with Form I-485, Application for Adjustment of Status. I am seeking an Advance Parole Document in case of necessary emergency travel to Canada while my Adjustment of Status case is still pending. I will not allow any such trips to interfere with my Adjustment of Status proceedings should they arise prior to receiving an Advance Parole Document.

If you have any questions, please do not hesitate to contact me. Thank you in advance for your time.

April 19, 2012 - Arrived in the USA on TN status working as a biologist

May 11, 2013 - Married USC

August 7, 2013 - Mailed AOS package (I-765, I-131, I485, I-130)

August 9, 2013 - Package received by USCIS

August 14, 2013 - NOA received for all 4 forms and checks cashed

Septemeber 11, 2013 - Biometrics Appointment

September 20, 2013 - I-485 Status changed to testing and interview

September 25, 2013 - Notification that interview has been scheduled for October 28, 2013

October 4, 2013 - Notification that I-131 has been approved!!!!

October 4, 2013 - Birthday updated on Form I-765

October 16, 2013 - I-765 EAD card in production!!!!

October 21, 2013 - I765- EAD and I-131 card has been mailed!

October 23, 2013 - EAD and AP combo card received and in hand!

October 28, 2013 - Greencard interview PASSED! Given an approved decision and told my greencard will be in the mail within 60 days!!!

November 6, 2013 - Conditional Greencard received in the mail and in hand at last!!!

You don't need to include an explanation to get AP. The reason is "I-485 application" which will result in a routinely approved AP. It's buried in the instructions there.

The I-131 form asks for a specific date that you will intend to leave the country, I don't have one as of yet but my brother has cancer and it's likely I will have to return at some point in the coming months. Any thoughts regarding how I fill this form out would be greatly appreciated.

The advice here is to just put "Unknown" for the date and length.

You can enter "Unknown" for the dates. You may need to hand-write this in.
