Hi All,

Here is the latest updates on our case, My fiance went to his interview, the consul told him to submit a waiver

the section she checked is Section 212(a)(9)(B)(i)(II) Unlawful presence in the U.S. for a period greater than one year, You are therefore inadmissible to the U.S until June 2016

Then she check , He is eligible for a waiver

My question and please if someone can help me What waiver should he apply for I-601? or I-212? or both together?

27th Jan, 2014 - Visa Interview - Refused Visa eligible for waivers I601 and I212
23rd Sep, 2014 - Visa Received

2nd Nov, 2014 POE Newark

6th Nov, 2014 - Married

7th Nov, 2014 - AOS, EAD, AP applications mailed to Chicago

10th Nov, 2014 - Applications delivered and Receipt Date

14th Nov, 2014 - NOA1 Date

20th Nov, 2014 - Received NOA1 hard copies

29th Nov, 2014 - Letter for Biometrics Appointment. Appt date - 12/10/2014

1st Dec, 2014 - Walkin biometrics done

13th Dec, 2014 - RFE email followed by Hard Copy on 12/19/2014 for Marriage Certificate

20th Dec, 2014 - Mailed RFE response with certified Marriage License and Certificate

21st Feb, 2015 - Received notice of potential interview waiver by mail

2nd Mar, 2014 - email received for EAD approved

You need to post all the information together. I just found another post where you state the embassy also asked for proof of the two of you meeting. What exactly was given at the embassy? Can it be scanned with personal information removed and placed here. Or can you type word for word what the form he was given asks for? Was he only told he needed the waiver for the overstay or was he also asked for proof of meeting in person? Sorry I don't remember your story enough to know if the two of you ever met or not.

Hi , thanks for your reply, the Co gave him a paper checking the the section that i mentioned in my post

on another letter he requested a prove in meeting and divorce certificate and civil certificate,

that what was requested when he was interviewed

About meeting in person, we submitted a hardship waiver to USCIS and we were approved , i explained my circumstances why we didn't meet , but now the embassy is requesting that so i was not sure if i should submit another hardship letter to them to waive the meeting requir. or else.
