Once the K-1 petition is approved it is then forwarded to NVC who then forwards a package to the respective Embassy. My question. Those the package sent to the U.S. Embassy include all of the documents which the petitioner submitted with the I-129F? My fiance is nerveous and has consulted with a lawyer in China. He is feeding her some information and is telling her that she needs documents such as my divorce decree etc which is already included in my package with I submitted with my I-129.

The petition you submitted will arrive at the Consulate. They will then send your fiancee a list of what documents she needs to bring for the interview (or you can find out in advance - see the 'Embassy info' section of this site).

Lawyers. Feh.

Most people submit a photocopy of important personal documents, such as birth and divorce certificates, with their petitions. But an immigration or consular officer can request to see the 'original' at any time, to verify the photocopy, and because the visa interview (and later on the adjustment interview for a K visa) is a convenient time to spot check such documentation it is a good idea for the visa applicant to have the originals available for inspection. Odds are excellent that at least 1 document will be asked for.

Keep in mind also that from time to time documents go missing from the file and may need to be replaced even though previously submitted. It's good to be prepared for the possibility - not your fault, but you pay the price if you're not prepared.

So if I am the US citizen, and I'm divorced, I have to mail the original divorce certificate to my fiance abroad? I'm afraid it would be lost in the mail.

Lisa and Spence,

Documents such as birth and divorce certificates are generally easily replaceable for a small fee, at least in most places in the USA.

When I started my visa journey, and it was not as clear as it is today that photocopys were acceptable as supporting documentation, it was routinely recommended that people obtain 3 or 4 certified copies of each of their government-certified documents. It's still not a bad idea today.

Have you had bad experiences with letters and packages that you send to your fiance getting lost in the mail?

You don't have to send the origional. A copy will do

I went to my county clerk and asked for 2 CERTIFIED copies of my divorce decree. I paid $9 for each certified copy. I made a photocopy which I sent with the I-129F package. I will keep one certified copy for my personal records, and send the second certified copy to my fiance along with:

-notarized affidavit of support + w-2's , 1040's, letter from employer, bank statements

-original birth certificate from the city register's office ($15)

-a NEW letter of intent to marry with a date closer to the interview date

-proof of ongoing relationship AFTER the I-129F petition was submitted

-ALL the original documents of which I made copies of to send in the I-129F package

-photocopies of EVERY document included in the I-129F package. Including a copy of the check.

-NOA2 Letter

I will also make and keep photocopies of everything above before sending them to my fiancee just in case they get lost. I'm covering every base.

Actually, yes we have. In July he sent me a package that I have yet to receive and I just sent him a small package where typically it only takes one week to recieve... it is now over two weeks and counting. We don't send too much to each other through the mail, and considering how many times we have mailed each other stuff... the lost percentage is pretty high. So I would really rather not mail him my original divorce certificate.

I'm surprised about this experience with mail between the USA and the UK, but given that that is what's happened to you I understand your reluctance. So, either hope that the consular officer does not ask to see the original, certified divorce certificate or head for the registrar's office to get a few extras.
