I-130 MARCH 2013 FILERS!! NBC

We didn't get married for my husband to be able to immigrate. We lived in his country for nearly 8 years together, 7 1/2 of those were while we were married. We have two children together and plan on trying for more. I don't understand why a fiance visa would be processed faster than a immediate relative one. It really makes no sense. The whole point of having the distinction between the IR and the CR is to lessen the amount of fraud that goes on. (At least, that's what they say.) What I'm seeing now, is that if I hadn't married my husband, he would have been approved in under 90 days, but because we got married, we could be waiting nearly 2 years for him to finish the process and be able to come over. This is absolutely ridiculous.

Exactly! My husband and I have been married for 10 years and we have 2 kids together...this is beyond frustrating!!! We too have been waiting over 6 months...ugh.

What if your file was never transferred to local office? It will collect dust at NBC?

Yes, this is the exact same question I have. What is going on with all of the files just sitting at the NBC???

Just saw a report 11.6 million illegals were able to get into the USA this year. How come we law biding citizens are kept waiting. I have resigned that it will be two years before my family get visas to live in the USA with me.

if anyone wanted to go so badly in the US, then they should not have been married to do that. If that was the goal, then they took the wrong road... there are shorter ways to do that.... apply for a K1 visa for example.. and do all the rest of the paper work in the US, while in the same time being with your fiancee.

for march filers a K3 is pointless, because what if you go to the US with a K3 non-immigrant petition and then your immigrant petition i-130 is not approved?

this makes the K3 in most cases not approved before the i-130, because they will wait for confirmation for i-130.

the K3 is for special cases, anyone can apply but not everyone gets it. It's like applying for a touristic visa, while you have an immigrant petition pending, that tourist visa is only approved if you can fulfill specific criteria, but anyone can apply, but not everyone gets it.

etc, etc.

at USCIS all paper works after are officially certified, are scanned and are added to your electronic file, no matter what for it is, i-130 or i-129f, marriage certificate, etc, they all go together..nothing is separated or taking dust somewhere.. it is a continuous process with procedures from the first day they receive it to the last, the starting point is the same for everyone (their PD), while the finishing line is different (their NOA2) because our situations are different, and the approval time is different.

Hope everyone gets approved very soon, and if u think USCIS complicates your life, at least don't complicate it yourself.no0pb.gif

If you are an undocumented illegal alien residing in us file i130 and it is not approved then what?

It is possible that the people who are discouraging others from filing for k-3 probably themselves filed k-3 and are trying this trick to prevent the 129f applications from clogging the service centers.

Hey guys, just wanted to post something Laurel Scott just posted on her FB (she is an immigration attorney and AILA member)

it's an approval of an i-130 i think, i don't understand why there is the K3 on his timeline too.

My time line says I-130 too. I tried to enter the K3 too but I could not. Maybe you can tell me how when you change yours.

    Laurel Scott They said NBC stopped sending cases to the local offices at the end of July, which is consistent with what we were told would happen when I went to the NBC meeting in May.

    Laurel Scott They also said NBC is sending I-130s to the Service Center, but I think the speaker was mistaken about that one. She represented the local USCIS offices in Florida, so I'm not sure she's 100% up to speed about what's going on at NBC. There is a new I-130 adjudication center at NBC and that's where I-130s were supposed to go when they stopped being sent to local offices.

    Laurel Scott The timeline reports are based on cases that are being decided now and how long ago the cases were filed. Imagine you are at a grocery store. There are long lines and a new cash register opens up. It takes one minute per transaction. 20 people jump in that line. So the first person who went through took one minute. That would be the posted processing time at that moment because that's how long it took the person who just finished. But the person at the end of the line will actually take 20 minutes, not one. Ok, so the next two people go through. That third person took three minutes. The posted processing time changes to three minutes. But that 20th person is still going to wait 17 more minutes even though the posted processing time is three minutes. Alright. Let's say we get to person 19 and suddenly two more people get in the line. Person 20 finishes up and the posted processing time is 20 minutes. But those two who just got in line will not wait 20 minutes. They will wait 2 or 3 minutes. Make sense?

So, I wrote to her. I asked her these questions:

"1. What conference was this? - I didn't think that AILA and USCIS would meet again until Nov, not now.
2. What was the big 'hump' that they had to get over? We have an educated guess about this, but would like to know what they acknowledge.
3. Did they say anything about staffing levels dedicated to standalone I-130s for the new Div 8 facility in Overland Park?
4. Has the Div 8 facility started adjudicating I-130s as the AILA-USCIS memo said they would 'by the end of the fiscal year' (Sept 30)?
5. Regarding your grocery line metaphor, are we right to surmise that March-April is #20 (will suffer the longest wait) on that line?
We have more questions but these seem to be the crucial ones. Any light that you can shed would be very much appreciated and we would be very grateful to you."
