I-130 MARCH 2013 FILERS!! NBC

if anyone wanted to go so badly in the US, then they should not have been married to do that. If that was the goal, then they took the wrong road... there are shorter ways to do that.... apply for a K1 visa for example.. and do all the rest of the paper work in the US, while in the same time being with your fiancee.

for march filers a K3 is pointless, because what if you go to the US with a K3 non-immigrant petition and then your immigrant petition i-130 is not approved?

this makes the K3 in most cases not approved before the i-130, because they will wait for confirmation for i-130.

the K3 is for special cases, anyone can apply but not everyone gets it. It's like applying for a touristic visa, while you have an immigrant petition pending, that tourist visa is only approved if you can fulfill specific criteria, but anyone can apply, but not everyone gets it.

etc, etc.

at USCIS all paper works after are officially certified, are scanned and are added to your electronic file, no matter what for it is, i-130 or i-129f etc, they all go together..nothing is separated or taking dust somewhere.. it is a continuous process with procedures from the first day they receive it to the last, the starting point is the same for everyone (their PD), while the finishing line is different (their NOA2) because our situations are different, and the approval time is different.

Hope everyone gets approved very soon, and if u think USCIS complicates your life, at least don't complicate it yourself.no0pb.gif

and you're an expert on immigration because......??????

Did you work at the USCIS ? or are you a VJ expert? just curious where you are getting your FACTS.

The K-3 is not for special cases... Everyone has the option to file. It does depend on the case loads at the service centers whether it gets processing before the I-130 but nobody has a crystal ball. I am able comment on the K-3 because I have personal experience. Did you ever get an approved K-3? VJ is a rumor mill as stated by another posted on another thread. It's fun to watch people post their approvals and progress but its for entertainment purposes only. It just passes the time while we wait. rofl.gif

So you're saying that the K-3 is pretty much pointless if it gets assigned an MSC number? Is that correct?

Can you elaborate on what you mean by using the K3 to my benefit with representatives?

Thanks

From my experience, if it gets a MSC number, then it has been put into the same folder as your I-130. It seems like the TSC is even sending those they receive to the NBC. I don't know what kind of policy they have in regards to the K3, but they aren't giving it any weight.

En-oh-eh-to now correctly answered the second question. The representatives should be furious that a law that they passed is being completely ignored. Depending on how long your representative has been in office and how proud they are, a good letter can be enough to get a ball rolling. The national average for processing times right now is a good reason to return to the K3 as this is why they started it in the first place.

No problem!

They are the ones who passed it into law over ten years ago. If USCIS does not process those petitions as intended, that would mean, in theory, that our representatives should act on our behalf. Unless of course, they are perfectly comfortable with USCIS completely disregarding laws passed by congress. I have already drafted a letter to my congressmen addressing this very topic. Of course, I cannot send it until a more appropriate time. That would be a. after the government is up and running, and b. after my I-130 and I-129F petitions have gathered enough layers of dust.

But how much dust is enough? I suppose should give the I-130 at least 6 months worth of dust, and for the I-129F, a thin layer of dust should be enough, let's say, 2 months worth.

Well said. So the general rule of thumb to write to your congressman is to wait about 6ish months or so? I just filed so I'd like to know for future reference.

Your statement "if anyone wanted to go so badly in the US, then they should not have been married to do that. If that was the goal, then they took the wrong road... there are shorter ways to do that.... apply for a K1 visa for example."

We just want to be together. If I could work in her country I would do that. So for us its not how to get a Green Card but its what do we have to do to be a family here. I did not even know about Green cards before I started this. At that time every where I looked most web sites said" Proof of relationship" is the key because so many people are just trying to get in any way they can. So in my thinking what better way to show "Proof of relationship" than being married.

And then most every site said K1 or CR-1 its all about the same time frame 8-10 months start to finish.

Hey guys, just wanted to post something Laurel Scott just posted on her FB (she is an immigration attorney and AILA member)

Just got confirmation at the conference that stand-alone I-130s (i.e. not with an I-485) stopped being sent to local USCIS offices several weeks ago. The local offices are trying to finish up their remaining stand-alone I-130s in the next few weeks. Unlike · Share · 46 minutes ago via mobile ·

Ok, it is like 4 people going in a bank to open a bank account, they all get a number and wait in the line, then they go to the 3 service desks according to availability and the number they have got, but that doesn't mean that everyone will finish according to the number they got, or spent the same amount of time at the desk. Number 2 can finish work before number 1.

In the Olympic games, every athlete gets a number, but that doesn't meant that number 1 will win the race.

This is how uscis works.

They even write in their form-797C this: THIS NOTICE DOES NOT GRANT ANY IMMIGRATION STATUS OR BENEFIT. because many people believed that if they got number 1, so they should be served first. And i believe that they wrote this notice in form 797C because many people were believing that 797C was granting them something.

I believe that NBC is working, and there is no reason for them not to.

To accept i am wrong is virtue,...... i often do that, headbonk.gif

Not to doubt in others is divine,........ i don't think i do this.yes.gif

We didn't get married for my husband to be able to immigrate. We lived in his country for nearly 8 years together, 7 1/2 of those were while we were married. We have two children together and plan on trying for more. I don't understand why a fiance visa would be processed faster than a immediate relative one. It really makes no sense. The whole point of having the distinction between the IR and the CR is to lessen the amount of fraud that goes on. (At least, that's what they say.) What I'm seeing now, is that if I hadn't married my husband, he would have been approved in under 90 days, but because we got married, we could be waiting nearly 2 years for him to finish the process and be able to come over. This is absolutely ridiculous.

With a fiancee visa you have to get married within 90 days of entering the US, if NOT, then a fiance visa is as good as a tourist visa which is approved within a week. Practically it grants you nothing. Both of them are classified as non-immigrant petitions visa categories.

A i-130 is an immigrant petition, and grants you a lot of things. No one is doubting the marriage of two people, but the two things are not the same. A tourist or a fiancee are not committed to immigrate in US, a marriage is not forced after you arrive in US, so that's why they are treated different. But according to the law we with an i-130 immigrant petition do intend to live in the US because we are committed through marriage to live together with our spouses, create a family wherever we are, especially when intending to live in US.

i hope it's a bit clear..

today it's exactly 7 months for me, hoping the approval is right around the corner.good.gif

Why are we fighting amongst ourselves... we are suppose to provide information to each other that we find in order to help cope with the fact that we are apart from our loved ones... this is like we are in a jail cell and they are testing us to see who breaks first and starts arguing with others... come folks... lets hold hands here... the goal is for all of us to get to the finish line and yes sometimes life is not fair, but are you going to sit and cry about it or do something... ?

So we are on this site, helping each other get through the days, weeks, months, and yes, ever years!!! lets not start bashing each other... please... this is the only sanity that we have!!!

I Agree, we just have different opinionsgood.gif

We usually don't know what is wrong or right, but if we all agree that one thing is right, it's completely wrong... because all can finish up doing the same mistake.

If there are two different opinions, then half of the people will be right, and half will be wrong. And if there are many opinions, the better.reading.gif
