Does the I-129F slow down the I-130 and/or start the process all over again? I'm trying to get clarification on this issue.

This question is on my mind as well. There is no indication that this is true, and no reason to think so. There's just too much misinformation out there. I want to be able to tell my congressman and senators that they passed the LIFE act into law, I tried to avail of it, and my petition is being ignored by USCIS. That is, if they continue to ignore the K-3 visa, which I certainly hope they do not!

any update regarding case approval (Noa2..) for 4th march filers.... ?

You're in Chicago? That means your file is probably in that field office. There is a massive backlog there, just like at the NBC. Then again, the NBC may have stopped forwarding cases there due to the backlog. Only way to find out is by contacting your congressman and senators.

If we want action, we have to force it. Only by contacting our congressmen and senators can we draw enough attention to the growing massive backlog of I-130 petitions.

I don't imagine our issues are even on the table with the government shutdown in full swing. Might as well wait until after this madness has passed and then contact them.

My case starts with MSCxxxxx.. letters. I don't know in which lockbox it is being sent by my wife..actulally, i am living in pakistan and my wife living in USA and she's US citizen and she's is petitioner,her brother has filed this case. I mentioned chikago lockbox in my profile just to create my account on Visajourney site.. can you tell me the case letters starts with MSC... in which lockbox is now.. ? so i will be better able to track the case and to know how much time it to take for approval..

Chicago Lockbox is where they ALL get sent initailly.... MSC is National Nebefits Center. You should change your info to NBC. Nothing gets adjudicated in the lockbox.

I too have asked this question over and over. If you get an answer with proof please let me know. There are some here that will tell you that it slows the I-130 to match the I-129f. But they will not show you how they know this if you press them for more information.

3-6 months was last year not anymore. As of right now it can be anywhere around 7-12 months. Ask your attorney why your file has not been approved since it has been more than 6 months already, all he will say is to wait more!

Question 14:

With the passage of the LIFE Act in December 2000 and the promulgation of implementing regulations in April 2001, both Congress and Legacy INS announced a policy that would, in theory, allow foreign spouses to join their U.S. citizen spouses in the United States quickly and avoid the long separation associated with increased I-130 processing times. USCIS has adopted a policy to adjudicate the K-3 petition (Form I-129F) and petition for alien relative (Form I-130) simultaneously. This practice effectively eliminates the benefits of the K-3 petition and frustrates the intent of the LIFE Act together. DOS takes the position that when the I-129F and the I-130 are approved together, the beneficiary becomes ineligible for a K-3 visa and therefore, proceeds with processing the immigrant visa application. Will USCIS reconsider its policy to adjudicate both petitions together and implement a policy to adjudicate K-3 petitions within 30 days in order to achieve the clear policy imperative announced by Congress with the creation of the K-3 visa?

Response

The K-3 visa was intended to reunite families separated due to a backlog in I-130 adjudications. However, I-130s are no longer backlogged and are currently being processed in under 6 months. Therefore, USCIS does not, at this time plan to implement a new policy on the K-3 visa petition process.

I case you dont know, it was set up as an option to get your spouse with you in 3-4 months (including the NVC time).

My point is USCIS has by policy denied any USC from using the option provided by Congress to timely unite thier familys thru this proccess. Because USCIS states that everything is working just fine now. Six months or less? We should get some traction with this Policy to push USCIS to get more people working on our Filings so they are completed in the stated time.

I had hope that people contacting their Congressmen would reference the statements in this past meeting. and ask that they honor the intent of the K3 or speed up the I-130

March filers - maybe you have more information about this:

I saw someone else on the April NOA1 thread randomly started entering MSC#'s in their range to get info and I thought I'd give it a try.

MSC1390787999 (March 14) and the MSC's after that with March 15 dates or later still seem to all be initial review. The #'s before that start showing interview times and approvals.

Is that what you are seeing here too?

6/6/2014 Finally have the I-130 interview. Approved on the spot! NOA2

I just got off of the phone with a tier 2 representative, thick accent and all. very rude lady. I asked about my service request since I am supposedly to know something today, and she said that NBC has received the e-mail and they have not responded yet. I asked if she can tell me when my case was touched last, "i don't have that information" I asked how much longer for the approval, she said maybe another 1-2 months, all lies i'm assuming. I asked if I can file I-129f or K-3 she said no point, since your I-130 is almost done. it will take another 6months for i-129f.

How can I get an infopass appointment? I live in texas, specifically houston. Thanks

The official average time as shown on USCIS case status web site is 16.6 months.
