There is no filing fee, and doesn't require all the same evidence you already sent in, so I would do it. I am just curious why the lawyer thinks that K-3's are being processed in 5 months.

Someone else told me I need to send in all the evidence again, and I really wasn't in the mood to do that. So I just need to send in the I-129F with the two passport photos and a photocopy of the NOA1 document? Correct?

I guess I'd be willing to. I don't mind waiting a while for NOA2 (I mean the earlier the better!) since I'm living with my husband right now. But waiting 16-17 months is unacceptable to me and I'd definitely try filing the K3. Maybe if I don't have petition approval by the end of the year I'll send in a K3 for the hell of it?

I filed an both an I-130 and K3 application. It's been over six months (for both) and I've yet to receive an NOA2.

Obviously it's NOT a five month wait for a K3.

But this is updated info. If they re-start the K-3's then you should be hearing something on it soon...

Check the K-3 guides. My lawyer is doing mine and he already has all the copies of everything. He just told me to come down and sign the I-129F petition. I know the K-3 moves through the NVC really fast. you just get a number and it gets shipped to the embassy. It doesn't have to wait for all the fees to be paid etc...

Wow, so the 16 months USCIS stated is in fact correct? That's really disheartening.

Well, I think its a good idea to file the K3 since its free and if my lawyer contacted me (without a call from me asking 1000 questions) there must be something to it. What can it hurt? I was reading on a K3 thread that someone got his K3 joined up with the I-130 and he got an approval for the I-130 soon after... I'm not saying that is why I'm filing it, but it sure would be nice if that same thing happened to me. I want to keep all my options opened.....nice and wide

Good points. Yes, I agree. It is very disgusting and kind of a joke when you compare it to other countries' spousal visa processing times. Really quite sad if you ask me. I get the feeling you don't think the Overland Park facility is going to get rid of the backlog anytime soon, do you?

I wouldn't count on that number being reliable, it's again just an estimate. I saw an I-130 that was approved today (not listed on the forum) and its giving me hopes.
