I-130 MARCH 2013 FILERS!! NBC

For real? If that was the case, we should have filed it from my country then. lol

I just noticed that some people who filed last feb they got approved in like a month or two.

My hubby and I called uscis earlier, we wanted to ask them where our papers are at, since in our NOA1 it doesn't really say where it is, it does have an NBC address at the bottom of the page but not even an email or text coming from them saying that it was routed to a different location, So we called and the person my husband talk to did not even provide a detailed explanation where it is, like she doesnt have any idea where the documents are. We are just really hoping that it's with NBC though and its not routed to some other location, for sure that would take even more time. This process makes me really anxious. unsure.png

My understanding is that US Citizens (Petitioners) if they have their home address outside of the US, meaning they are not living in the US and filed for IR1/Cr1 for their spouse, they get approved in roughly 40 working days. However, if the US Citizen has the home address in the US and has been living in the US, they have a long long wait.

I still know people with July/Aug 2012 i130 NOA1 waiting for NOA2, These guys were not even given any RFE yet and their status online just says Initial Review.

My wife filed for me in Dec 2012 and we are still waiting for NOA2.

My wife filed for me and my daughter on March 8th. We both reside outside the US and she's never lived there. We filed through a US lawyer. Does this mean there is the potential of a quick NOA2 since we are both not in the country? It's been almost 60 days, so we are beyond that 40 day theory.

You said you filed using a US lawyer. He should be able to tell you where he sent the documents. If it was not filed at the consulate in Canada. You are filed like the rest of us in the US.

The other post said that a non-US address from the petitioner and beneficiary could cause this somewhat expedited process. As far as I've heard, I-130's must be filed at a US lockbox.

Can anyone clarify?

I think i found it...

"Petitioners residing outside the United States are no longer able to routinely file Forms I-130, Petition for Alien Relative, with U.S. embassies and consulates. Petitioners residing overseas in countries where USCIS does not have a public counter presence are required to file their Forms I-130 by mail with the USCIS Chicago Lockbox. U.S. embassies and consulates can only accept and process Forms I-130 in exceptional circumstances"

"U.S. embassies and consulates may only accept I-130 petition filings from petitioners who believe they have exceptional situations that would merit an exception from filing by mail to the USCIS Chicago Lockbox."

So, I am assuming that this slightly more speedy process refers to having an out of US address.

10/24/13 - Case transferred email (transferred to other USCIS office)

10/25/13 - Case transferred email (transferred to local USCIS office)

10/28/13 - Hard Copy transferred mail (CSC)

11/4/13 - Case was Touched

Looks like we both got NOA 1 on the same date and I get the same msg. in case status page.

So, don't know where it is and what is happening to it.

Who knows how long...every application is different. I see some members approved within 30 days and some 180 days. Hopefully we don't fall under the 180 days category. What did the USCIS tell you? Did they say where your application is? i.e. with benefit center or the local field office?

NBC process cases within 60 days. However, unless the USC is abroad with the beneficiary, it is unlikely that your case will stay at NBC, but will instead get sent to your local field office.

USC who lived in Manabí, Ecuador with hubby from 2009 - 2013. Hubby became a naturalized American citizen in August 2016. Currently living together in northern Virginia.
