I can't find anywhere else to post my question, so I'll post here:

My husband and I filed our initial papers in March 2013. I'm now putting together my AOS papers. I was unemployed in 2010 so I didn't file because I didn't make any money. Of course, I wasn't married then and didn't anticipate that I'd need three years of tax returns. I'm now gainfully employed but now face a question.

Do I go back and refile my 2010, which would be easiest but not financially good, or do I file married, filing jointly and amend later? If I file married/jointly, will my return be questioned if his info isn't on it? If I file single (because he's been in Ireland the entire duration of our year long marriage) will that be questioned? I figure they are really looking for my info so sending them a copy of my tax return without his info might be ok.

We got married Jan, 2013. This process is taking much much longer than we anticipated and I don't want to risk making it longer or being denied.

Any insight would be welcome.

You could also ask this in the NVC thread, but I'd say that you don't 'need' 3 years although it's suggested as helpful. If the interview isn't until after April 14th, you need to have the 2013 taxes available anyways. And if you didn't file in 2010, then just include a statement of why you didn't file - I've seen that suggested in the NVC thread repeatedly.

On Monday our lawyer received the RFE. They are asking for an updated biographic form for me, photos which should not have been taken more than 30 days from receipt of the RFE, ORIGINAL marriage certificate, and translated copy of the marriage record booklet. Can I get the marriage record translated in India and mail it to my husband?

12/30/2012: Got engaged.
1/16/2013: Got married in India.

I-130:
2/28/2013: Attorney mailed the I-130 from a U.S. address.
3/4/2013: Priority date, NOA1.
11/6/2013: Case was transferred to Nebraska Service Center.

1/6/2014: 60 days of transfer are up, put in an e-request, given 30 days' time. Contacted the senator. Senator asked to wait till Feb 6 and if nothing then she will do something.
2/5/2014: Website status changed to RFE.
2/10/2014: Attorney gets RFE. They need G325A and photos of both me and husband, original marriage certificate, copy of marriage record and it's translation.
2/15/2014: Mailed the requisite documents to husband.
2/19/2014: Documents received by husband.
2/24/2014: RFE mailed.
2/26/2014: Case status changed to RFE review.
3/6/2014: After 367 days, NOA2.

After approval kept calling NVC but NVC always had one reply, file was not in their system. Husband too called USCIS National Customer Service Center and was told case was sent to NVC.
4/2/2014: Write to NSCFollowup to know about the status of the petition.
4/10/2014: Put in a ?service request with USCIS starting with OVP to locate case.
4/16/2014: Reply from NSCFollowup that the U.S. law prohibited that office from responding to anyone other than the petitioner and to have the petitioner contact them.

What is "translated copy of the marriage record booklet" ? Is it memorandum of marriage? Which state are you from in India? I believe you can get it translated in India. If you send the original to USCIS, makesure you have another certified copy B/C NVC will ask for one as well.

I am from the state of Andhra Pradesh. The marriage record is the pact of marriage in my mother tongue, Urdu and has information about whether the criteria for performing marriage were met, who were the bride and groom, witnesses, etc. Both the bride and groom have their own copies.

Someone recently posted that there is an increase to the poverty line, and suggested that 'being close' would best be addressed by having a co-sponsor. Maybe check out the new amounts if you can find it, or if someone else can provide that info here. I can only find the 2013 values:

No, I didn't receive any response for my e-request. They did say I should hear something in 30 days and 30 days later we got an RFE, but I don't know if it was because of the e-request or because we contacted the senator one day before the 30 days were up.

12 months completed today bt no approval yet....

Did you contact senator/congressman? I think that did the trick for me. You should try that if you haven't already.

12 March 2013 - NOA1
31 October 2013 - Transfer to NSC
5 February 2014 - NOA2
