I-130 MARCH 2013 FILERS!! NBC

I believe it !! but it just makes more sense ( to us LOL) to just finish processing each file rather than having to go back.... They still have to go back to each file when the infomation comes in.. That takes time too... UGHHHHHHHHHHHHHH

You would think so, but in the first level of processing, no one had specific cases assigned to them. You would walk over to a bucket, (which were those big, white Post Office buckets), and grab a pile of folders. So, they did not care about anything but their numbers. The only ones who had specific cases assigned were the Governor's Referral Unit. You got a case and it did not leave your desk until it was finished and approved by the State. I got transferred there, but after a few months, the supervisor came over and said we all had to process our reg cases and 15 "MISSING" cases each day. I could not do it. I kept calling everyone bc it was so heartless to make ppl wait bc of a simple thing that could be fixed in 20 mins.

Man this tier 2 cracked me up! I said I got this RFE, but the marriage cert I sent in already had the information on it. He says "well if you already sent it in, I don't know what else they want!" I was like "me either!!" rofl.gif

Anyways. So I have to send a cover letter, dated and signed, explaining that it is a certified copy and where to find the date/time when it was registered.

Going to DHL it tomorrow. *sigh* One day this will all be just a nasty memory... right? cray5ol.gif

So got the RFE today- they said "the copy of the marriage certificate you submitted does not indicate your marriage was actually registered with a civil authority in the state of Colorado. Therefore, please submit a complete and legible copy of a marriage certificate establishing that your marriage was registered with a civil authority"

What does that mean? I already sent a certified copy, do I just send another one?

Wait! Don't just send the same thing back! When I was going through immigration in the Netherlands, they rejected our county license, and wanted one that was apostilled by the state of NJ. You can probably order it online or go to the state's record office and get it right away. Perhaps, as stupid as it sounds, that is what they're asking for.

Man they better not want one that is apostilled! That would be so stupid!

I think I'm going to send in the one I have tomorrow, just to try to get things rolling. Then I'll also call to see if I can get some apostilled copies sent to me. There's no way I can just drop by Colorado and pick them up. When I had to get apostilled documents from North Carolina for residency here in Costa Rica it was either go to the office and do it directly, or order them and wait a month to get them in the mail. So I'll send in what I have, and if it's not enough then hopefully the apostilled documents will have arrived by then and I'll send in those.

Is the apostilled version for international not domestic? I have no idea. I never even heard of it until i read i had to get all my docs certified before sending them to the embassies in wash dc.

How long do they give you to return the rfe?

I have a forgetful uncle who might remember to get it done if I bother him a few days in a row.

I'll call tomorrow and see what the deal is for getting an apostilled license. And I don't want to sound unappreciative, but I honestly really doubt that that's what they want. Nowhere in the RFE did they mention there was an issue with it being certified, just that it wasn't registered. I feel like an apostilled certificate doesn't change whether it was registered or not, just whether it is a real document or not.

So here's the cover letter I wrote, does this seem professional and specific enough?

Please find attached a certified copy of my marriage certificate. It has indeed been registered with the civil authorities and you will find note of this on the front page where it gives the Reception # (######), Document Type (marriage license record), and Record Date (1/15/2013). On this page you will also find a raised seal from [name] County and signatures certifying the information. Also on the actual copy of the marriage license/certificate (both are found on the same page) at the top there is a date and time stamp of when it was registered with [name] County, Colorado County Clerk and Recorder. “Reception #: ######, 01/15/2013 at 01:32:18 PM…” et cetera.

If you have any questions please feel free to contact [name] County Clerk and Recorder at (970) ***-**** where they will confirm that the marriage has been registered.

That being said, if they wanted an apostilled marriage certificate for everyone, then they should have stated so in the instructions. I would totally send an email to the Ombudsman, btw. You've been waiting a long time since you apparently "got" your RFE only to find out that it's ridiculous.

The USCIS site says:

If you contacted the National Customer Service Center with a case-related inquiry and more than 30 days have passed and you have not received a response, you may email the appropriate USCIS Service Center with your inquiry:

They realized they were about to get a bunch of emails? :P The address hasn't even been changed on their website yet. I'm assuming that they just decided to change it today, since I sent more than one email to that address and never got any response, much less one saying that the address was not operational anymore.

I'd send messages to both addresses. :P

Apostilled versions are longer (for the marriage certificate), contain more information, and I believe are acceptable for foreign governments. At least, that's how it worked in the Netherlands. I had to get everything apostilled. Marriage license. Birth Certificate. Etc.

I have a forgetful uncle who might remember to get it done if I bother him a few days in a row.

I'll call tomorrow and see what the deal is for getting an apostilled license. And I don't want to sound unappreciative, but I honestly really doubt that that's what they want. Nowhere in the RFE did they mention there was an issue with it being certified, just that it wasn't registered. I feel like an apostilled certificate doesn't change whether it was registered or not, just whether it is a real document or not.

So here's the cover letter I wrote, does this seem professional and specific enough?

To whom it may concern,

Please find attached a certified copy of my marriage certificate. It has indeed been registered with the civil authorities and you will find note of this on the front page where it gives the Reception # (######), Document Type (marriage license record), and Record Date (1/15/2013). On this page you will also find a raised seal from [name] County and signatures certifying the information. Also on the actual copy of the marriage license/certificate (both are found on the same page) at the top there is a date and time stamp of when it was registered with [name] County, Colorado County Clerk and Recorder. “Reception #: ######, 01/15/2013 at 01:32:18 PM…” et cetera.

If you have any questions please feel free to contact [name] County Clerk and Recorder at (970) ***-**** where they will confirm that the marriage has been registered.

I went ahead and looked up the information for you for Colorado's apostille, just in case that's what they're looking for. https://www.sos.state.co.us/pubs/notary/apostilleHelp.html

That being said, I've read and re-read, and that *shouldn't* be what they're asking for. (But it's not like we haven't heard them asking for things that are not requested in the original instructions like the beneficiary's birth certificate, or for things that have already been sent in previously.) I included apostilles for everything I had, both for me and for my husband, but they're attached to the originals, so I figured it couldn't hurt.

Would it be possible to get a faxed statement or emailed statement from the county clerk stating that your marriage is registered?

I don't get it. Are they just grasping at straws now? If you sent in your marriage certificate, and you were married in the US, I honestly can't figure out what the problem is.
