I just sent a email asking about my case to NSC. its been over 30 days to be exact 40days since my files were transferred. Course they have not answered typical. I wish there was a way to make accountable.

on the notice of transfer..they mentioned if your case doesn't have approval after 60 days of transferred you can contact them.. they put on the letter we should have result within 60 days...

I read in earlier post someone said you could ask after 30 days. you are correct it does say this in the letter also I think you can ask to have it expedited. I just think you have to keep them accountable I mean being a pest.

I sent one last week for a similar reason.

Finally got our NOA-2. Got the approval email on friday 9/13... and today the NOA2 was in the mailbox. Exactly 9 months for approval (priority date was 3/13)

The people who got transferred there first and who have earlier PD's (and who aren't from the Philippines) should be dealt with first.

Absolutely! It is so misleading for them to say that applications are processed according to when they are received. I know there are tons of variables, but the process/criteria they use should at least be available so people can have a better understanding of what is going on. It goes back to the lack of transparency and to me that is basically being purposefully deceptive by omission.

Oh, I don't doubt that is the case. I think they're processing the newer cases to bring the average down and leaving a large hunk of the older cases back in the meantime. The problem is that they show the average processing time, and not the mean processing time. I would love to know what the mode or median was with our cases. That would probably be much more illuminating.

Just called again and after waiting on hold for about 2 hours the guy told me that I don't have an RFE. I told him that I have an email stating I have an RFE and he said it was incorrect, no RFE has been issued on my case.

Just wrote another email to my congressman and senator. I plan on writing once a week every week until I get my approval. I'm annoyed with this process, they're going to be annoyed too. I also wrote up my form for the ombudsman, I'll scan it and get it sent out tomorrow.

Guy on the phone told me to "be patient". I told him I've been patient for NINE MONTHS.

Btw, my Congressman and Senators are entirely useless.

Senator Cory Booker's site has been screwed up for weeks so I can't even submit a request for help. (Going to call his office today.)

Senator Menendez has had my case since the beginning of November. I gave them the requested 14-21 days to respond, and nothing. I've called and left messages for their Immigration Liaison repeatedly this month and have not gotten a call back. Finally got her on the phone today, and she tried getting me to resubmit my privacy waiver and information until I interrupted her and told her that she's had my case for nearly 2 months already. She put me on hold, then came back with "It looks like we sent an inquiry to the USCIS on Nov. 19th and haven't gotten an answer back from them yet. Is there anything else I can do for you today?" OMG Are you for real, lady? If I don't hear an answer from her by Friday, I'll be calling her again, and making sure that she actually followed up on my case.

And Congressman Chris Smith is even less than useless. I contacted them repeatedly in November. Even trying to get the privacy release from them took 2 weeks and constant prodding. Once I sent it out, I couldn't confirm that it had gotten there for over a week because one person was out sick, and no one else checked the mail, or something. I got an answer rather quickly from them after they confirmed that they had it. (Under a week.) This is probably because they called the same line that we call and spoke to a tier 1. At least, that's what I'm assuming based on their answer that "It was transferred to Nebraska on Nov. 7th, 2013. Call back if you don't have an answer by March."

I did contact them after that because of the confusing processing times, and received the following response in the mail:

Dear Mrs. Kaylara,

I contact the USCIS per your request by telephone concerning your I130 application and was informed in order to expedite your case, it was transferred from the NBC to the NSC on November 11, 2013. The typical weight times are five months; although I was informed they are trying to process cases within three months.

I will continue to monitor your case in the meantime and just as soon as I have additional information, I will notify you. If there is anything else I can be doing for you, regarding this or any other federal matter.

(Please note, I abbreviated the Service Centers and USCIS's name. But the rest of it is exactly what was sent to me.)

*head desk* So, if you're in NJ, save yourself some time and effort unless you're beyond posted processing times. Because these people are probably not going to help you unless you have some kind of massive emergency. And even their help, if you can call it that, sucks.

He got very snippy and said "do you have any more questions?" In his defense, I was angry long before he was.

My congressman (David Price) and senator (Kay Hagan) have been of zero help. And I'm sure they'll continue their uselessness for the remainder of my case. But I don't care. I'm going to annoy the hell out of them. devil.gif

Really renews your faith in the competence of our elected officials, eh? I'm headdesking right there with you.

I contacted my senator, who returned the standard "6 months from the date of this notice" response, and congressman, whose office assured me they'd look into it but never actually got back to me. I haven't bothered to follow up. They really are useless.
