Hello, I need your guys help. My case was approved on September 5th, 2013 and NVC still didn't receive it. I called USCIS in October and found out on Nov 5th that Philadelphia has my case file. Anyhow on Nov 5th I got an email saying:

Our records indicate that your I-130 petition was approved on September 5th, 2013. In accordance with your request, your petition is presently being processed and will be forwarded immediately to National Visa Center (NVC) for consular processing.

I called NVC yesterday before they closed they still don't have my file. I called both of my senators office and they are saying you must wait. They are not willing to help. It's been 79 days since my approval. I scanned a copy of approval to NVC they said they will contact USCIS for file location. It took them 22 days just to tell me that. I submitted a inquiry with ombudsman got no answer. What should I do? Someone please help me if you could give me some advice please. I am just tired and see no way out of this damn hole.

You should post in the NVC thread, you'll get better help there. From the FAQ:

What happens if my case doesn't arrive in a timely manner? (Timely manner being the current wait time)

VJ member tokinaija suggests: "Call USCIS, and specifically request to be connected to a Tier 2 supervisor (bypassing the contract customer reps). When connected to a Tier 2 representative, request that you want confirmation that your approved case has been physically shipped to NVC. In amenable words, request for the specific date that the package was shipped. If you are lucky, you will get someone who would take the time to confirm this for you.

Just mailed off the RFE material that California asked for. I had left out a court paper from first marriage. I was so glad I had this paper in my files!

I mailed it Priority Mail for Monday delivery, so hopefully our case will crank back into processing and maybe we'll get approved soon.

From the time I got the text that said I was going to receive the RFE, it took 4 days to get the paper letter. I don't know if this is a typical time or not, but I was very glad when it did come, so I can certainly understand why you're anxious about it.

I experienced the same. On the original notice, the date was Feb 28 but on the transfer notice, it was March 4. Think no problem.

Just FYI- if anyone cares.

I'm going to be staying away from VJ for a while. Seeing the under a month approvals is getting under my skin, and I need to avoid it. The fact that there's basically 0 approvals coming out of Texas is not making things easier. If I happen to hear any news I'll check back in. :)

Good luck to everyone! We have waited long enough and everyone here deserves to be approved before the year is up.

Best wishes!!!

HAPPY TURKEY DAY Costa Rican style !! LOL

I just talked to my husband a few minutes ago. He mentioned that maybe the USCIS makes people wait ridiculous amounts of time to see who bails out. He said it so hard to wait and maybe some people bail because they just can't take it anymore.. so sad

I totally understand how you feel about staying away.. I want to do the same but I haven't been transferred yet. I want to watch the progress.

Best wishes to you
