It seems to be a pattern with the shortest being just over 2 weeks!!! and the thread was started in 2012 and it seems it still is working...


My husband and I are living overseas together, but our lawyer sent the papers in for us from the U.S. so not sure if that makes a difference or not...??

Does it really make a difference though if the couple live together overseas? It makes the process go faster??

I think as long as you make sure both USC & Foreign spouse addresses in I-130 and all related forms are abroad , that its.

we also filed from abroad but shipped it to my parents who then mailed it to chicago lockbox.

Just an update on our case. As some of you might know from some of my previous posts, a couple weeks ago the USCIS website stopped showing my status.Up until then I had always been able to check my status. Many on here said sometimes when that happens you will get an approval soon or and RFE soon. Well I have called them 3 times in two weeks to check my status and make sure everything is going OK. I talked with tier 2 all three times. They assured me everything is ok and no problem it was not being worked on but still waiting at NBC.

Then just today in the mail we got a letter, an Request For Evidence (RFE). It is not a big problem just a date on a paper that was translated does not match the original document. So we have to have it translated again and send the correct form. So maybe there was some truth to the earlier advice from others on here about the website change will result in some kind of update. However, that is what makes me so angry. My wife and I both live in Viernam and it took a while for the mail to get delivered here. In the mean time I have called 3 times and never once was the RFE mentioned!!!!!! In fact they said our case wasn't being worked on when in fact it obviously was.

ANyway, at least I know they are working on our case and hopefully this will be resolved soon.

Can anyone tell me what the vaccination requirements for exam. I see that the Hepatitis B and the Influenza Type B are required and they are the only ones I don't have. On the USCIS website it says age is a determining factor for the Hep B but doesn't say what. I read on some other sites that you don't have to get it if your over 18 but not sure. Also it is in 2 doses each have to be at least 6 months apart. Will me not having the second does create a problem or could I get that after I enter the US. Any other useful info on vaccination appreciated.

I think you should be asking this question in the NVC filers thread. They would give you more information. I would also advise you to join the regional forum where you might be able to get precise answers related to your country.

Who knows how long it will be held and yes it will be sent to local office after waiting at NBC for almost 4 months, this is ridiculous.

some petitions do get processed at nvc that are not filed from abroad although there are few

highly doubtful that it will be at nvc for four months until transfer.. most take place between 1 and 3 months

best route is to call uscis 4-5 times.. when you get the same answer three times, then you have the correct response.. gotta love the gov't

Did you mean NBC? Apparently it's been taking longer than 3 months to be transferred to the local office, maybe this longer wait time is affecting anyone who filed in March or after?

sorry, yes meant nbc .. I have not heard anything about a file taking longer than the three months to transfer, but good to know

I called the authorized clinic to find out which shots i'd need to have if i don't have any previous history in writing. They told me names of two vaccines (one for tetanus and such and the other for measles, chicken pox and something else) and said that'd be enough. I think you can also ask them about the timeline limitations.

Just thought I'd share the most recent part of our journey, in case anyone runs or has run into similar problems.

As previously mentioned, our I-130 was approved on June 12th. We received the NOA2 email immediately, but my husband didn't get to read the printed version until June 23rd, because he was visiting us in Canada. When he did read it, he found that they had made a mistake: they think I am already in the US and wish to file for adjustment of status, and so they tell me to contact the local USCIS office. But I am in Canada, and we clearly indicated this on our I-130. This is clearly their mistake.

The NOA2 does state that, if we want consular processing, we need to file an I-824 and ask them to send the file to NVC. However, the I-824 can take months to be processed, and we shouldn't have to wait that much longer because they made a mistake.

So my husband has been calling USCIS and getting all sorts of responses. One person told him to wait 90 days to make sure NVC doesn't get our petition. Another told him all petitions are automatically sent to NVC, and that he needs to send NVC a letter requesting consular processing. But if all petitions are supposedly sent to NVC, why does the NOA2 state that we need to file a form in order for that to happen? A third person told him the same thing, that all petitions are sent to NVC, and refused to connect him to Tier 2; he/she also added "Your wife can always come to the US as a tourist and then file to adjust her status." Correct me if I'm wrong, but isn't that perfectly illegal?

I've pretty much lost all trust in what they tell me. My husband has an Info-pass appointment in early July, 20 business days after NOA2 was issued. In the meantime, I'm still calling NVC, on the chance that maybe our petition was sent there after all. If we can't locate our file by then, I guess we'll try calling the congressman's office?

It's all very frustrating. Then again, we were fortunate to have our I-130 approved quickly, so I suppose you can't luck out all the time. I'm trying to be calm about it all.

03/29/2013: NOA1 email received

04/05/2013: NOA1 hard copy received

06/12/2013: NOA2 email received - Approved! (75 days after NOA1)

06/14/2013: NOA2 hard copy received, but mistakenly states that I am already in the US

07/09/2013: Infopass meeting, told file is at NRC, steps taken to retrieve it

07/26/2013: letter from USCIS stating file has been retrieved and sent to NVC

07/30/2013: Infopass meeting, information confirmed

NVC:

07/29/2013: NVC received case, notice sent and received a few days later

08/09/2013: NVC case number assigned

08/11/2013: paid AOS bill (marked as paid 3-4 days after)

08/12/2013: filed DS-261 (electronic version of DS-3032)
