I asked where my K-3 was being sent to. She told me Lewisville, TX. And then I asked if that was considered the TSC.... and she answered "YES"

I believe it has something to do with where you live. I live in the Philadelphia area. We'll see what mine comes back as. Who knows, it might be sent to Texas and then to MSC or the opposite. I pray it gets sent to TX. They have the shortest processing times.. for the K-3 and the waiver I need

I wouldn't say "OFFICIAL" I'd say more like.... "good enough for me" I'm not going to sit back and accept the slow I-130 processing times.. If my lawyer says he wants me to file the K-3... then I'm going to file the K-3. It is Free.. he's not getting any more money from me. So,

as far as making more work for the USCIS.... yea well, job security for them then... My 4 inch K-3 package will be processed at the TSC and if people want to sit back and relax, well then I'll see ya at the finish line. Maybe I'll get there first, and Maybe you'll get there first.... nothing is for sure around the USCIS.

i'm just thinking why do i need to pay a lawyer if my petition gets same treatment as all others who filed it themselves or myself? all petitions are free to fill, as far as i know lawyers are other things..

they promise now the K3 is faster, but that's beyond their power, so they also hope like me and just sit back as me..

anyway i really wish you get approved as soon as possible, but i am just trying to be realistic a bit.

The lawyer has no control over the USCIS and how fast they process....and anyone who hires a lawyer to get processed faster is barking up the wrong tree. so the statement about him not delivering is silly. he is doing what I hired him to do.

I didn't hire a lawyer in hopes to get better treatment, I hired a lawyer because my case is NOT a straight forward case. I wanted a professional to do my paperwork. I could have done the initial filing , but why if the price is the same flat fee? And there is alot of preparation with the tail end of my case...Its much easier if he has everything together. Plus, it is more paperwork if I add a lawyer later.

The K-3 is free to file for anyone. If it is free, why WOULDN'T you file?

Nobody is making a promise as far as processing times go... Everyone knows they are only posted estimates

so with that said, Doesn't it make sense to file a FREE petition that has an estimated 5 month processing time rather than sit back, relax and wait for a petition that is estimated at 16 months? It makes sense to me....

Some people hire a lawyer due to some type of complication in their case, or else if you have a straight forward case then you don't really need a lawyer. As for Lovemytico's case there is some type of complication and that's why she has a lawyer and you probably have a straight forward case so you don't need one.

Your I-130 was not FREE.. They won't touch it without the $420 fee

I think you could try contacting the AILA or your Congressmans office and ask them to help bring the I-130 proccessing times within the 6 months they stated. I mean this is something you can do. add your voice to many and maybe they will hear us.

I understand the feeling of impotency, Tico, but I do feel that ought to keep trying. I just wrote to the AILA again. Hat-tip for the "question 14" quote. Let's keep doing our best. Here's my letter:

One month ago, I shared the information below about fears that the processing of standalone I-130's would slow down significantly. Recent events confirm that our predictions were correct. I would like to suggest a possible resolution.

First, you should know, if you do not know already, that since I wrote this email to you, the USCIS has revised its national average processing times for I-130's, so that now they report 16 months, between a NOA1 and NOA2, just to adjudicate an I-130 petition. That means, that American citizens and legal residents who are married to foreigners, are now expected to wait up to two years to unite with their spouses.

Members of my online community of I-130 petitioners and beneficiaries at VisaJourney.com had already noticed the slowdown, based on our self-reports, when I wrote to you. We foresaw this slowdown, because we noticed that petitions were being sent to the new NBC facility in Overland Park, Kansas, which we knew was not operational. And the USCIS did not appear to be sending petitions to field offices to keep up with the pace of adjudication, as they said that they would, because very few of us in our online community were notified that our files were being sent to field offices. Hence, we foresaw the stockpiling of I-130s, which has created this slowdown now.

My suggestion is that you again ask, in stronger terms, will the "USCIS reconsider its policy to… adjudicate K-3 petitions within 30 days in order to achieve the clear policy imperative announced by Congress with the creation of the K-3 visa?" I am referring to question 14 in "USCIS – American Immigration Lawyers Association (AILA) Meeting April 11, 2013". That document is here:

Their answer at that time, was, "The K-3 visa was intended to reunite families separated due to a backlog in I-130 adjudications. However, I-130s are no longer backlogged and are currently being processed in under 6 months. Therefore, USCIS does not, at this time plan to implement a new policy on the K-3 visa petition process."

But clearly, the premise of no "new policy on the K-3 visa petition process" is that " I-130s are no longer backlogged and are currently being processed in under 6 months." That premise is no longer true, by their own self-report - 16 months for I-130 adjudication.

Maybe the new Division 8 Overland Park facility is operational now, as USCIS stated it would be, in their conference with you in the spring. However, we have seen little evidence that adjudications are proceeding at a rate that will quickly reverse these trends. Our inquiries have not yielded any information that might relieve us of distress. We are facing unimaginable circumstances – very long separations.

We expected to wait when we sent our petitions. But even the most patient of us are now bewildered and angry. We are reaching out to our congressional delegations, notifying television news and starting online petitions, but these efforts do not seem to carry any noticeable influence. Proof of all that I am saying is available online, and publicly viewable.

We hope that you might do something that will stir USCIS to action.

I have contacted my congressional office and other political figures . Since the government is shutdown, those offices aren't open. As soon as I hear the shut down is over, I'll be on the phone with those people again. I should be getting a text with my K-3 notice on Friday. Monday at the latest. Then I can add a few questions to my list for the senators office.

I'm not upset... I just hate waiting as much as the rest of you. Wanted to share the info I was given. I know I have to wait like everyone else. I don't like it so I am doing what I can to help it along

Bad day at work today made me really want to quit and move back to the USA. But I guess if processing times are really 16 months I'll have to suck it up for the next year. The silver lining is if by Jan 2015 we're still in Costa Rica I can apply for citizenship. And then if one day we decide to go to Brazil I won't have to pay for an expensive visa.
