So basically you go for your interview and it does not go well, AOS denied..does your spouse return back to his/her country?

what happens then ?

have not started my visa application, have not decided what route to take, planning my trip to America, and asking questions to see what best route to take . *breathes*.

nothing happens you need to hire a Attorney and spend $$$$ :P:yes:

So do AOS denials happen quite alot? And what are the main reasons usually...

Like I mean what if you can't afford a lawyer and wife is pregnant , damn!!!!! I hope this does not happen to me ... This whole experience sounds scary!!!!

As long as you have all the required documntation and are in a legitimate marriage then you have nothing to worry about. We spent countless hours putting together all the paperwork for the AOS interview and it last all of 15 minutes.

your thinking is valid but only when the case is not straight forward or it is complicated now there could be many factors which apply and if you could open up and tell why you feel so some1 here would definitely help you out dont feel shy spill it out

Your fiance got into the US on a K-1, you got married in time ,you filed your AOS forms which include that you have a job and pay taxes...

But if you have nothing to hide and you are both good law abiding citizens you will get your Visa....

^^ Ahh thats put me at ease lol! so why do people say the AOS interview is really pressuring and they are harder on you etc etc.. Like i mean getting the documentation together is not as hard.. but I'll just have to wait and see.. Thanks!

ok after reading your post I am relaxed lol! ok that sounds simple! well I have nothing to hide so hopefully all should go well UNLESS the medical documents have some errors made by the civil surgeon which i pray won't happen!

LOL I am the same as you Baf I worry alot and yes the whole process is terrifying. We just mailed our K1 petition to Nebraska and well I have been researching the whole process for nearly 4 years now and I feel I know what to do etc but I still worry!! I think our case is straight forward, we dont have any skeletons in the closet, I have never been in trouble, my fiance had a car accident years back (I think it was about over 6 years ago) where the other person died but i dont think, or hope, that isnt gonna effect us. We have all the proof well lots of photos of each other the only thing we dont have is communication as we talk in voice chat alot but I do have phone bills for calling him. My fiance is so laid back he keeps telling me to chill and we will deal with things when we get there! I am freaking out mainly about his financial situation in that he earns well above the 125% of poverty guidelines but unfortunately his bank account isnt all that good, he has been in the negative alot within the last 12 months, due to the fact that his mum has had to move in with him and he is helping her pay for her credit cards and just basically paying her bills. :( I will have enough money of my own when I sell my house here in the UK but most of that money will go towards a home for us over there:)

ANyways I am blabering LOL as my fiance tells me - DONT WORRY ABOUT "WHAT IF's" DEAL WITH THE "NOW"! I know easy said than done but if I can do it - so can you! Take the plunge and do it if thats what you two want. LOVE DOES CONQUER ALL!

The vast majority of AOS Interviews I have read are quick and basically a non event.

As are consular interviews.

You only get detailed info on the few, very few, that have issues.

Issues are both more intersting and give you something to actually write about.

OK. Here are your options. She gets denied when you go for AOS. She will need to return to her country. Well, now you can file for K3 and try all over again! Or if you move to her country you could do a DCF (Direct Consular Filing.) That is if you still want her to come and live in USA.

Or, you could move to her country and apply for residency there.

There's more than one way to skin the cat! :lol:

If your marriage is legit and nothing to hide.. then why worry.

Apr - 2006 - APPROVED AOS Without Interview!!

Feb - 2008 - REMOVAL of conditions!!!!!

02/20/2008 - Package was sent to TSC.

02/25/2008 - Package confirmed received at TSC.

FWIW, AOS denials are practically unheard of for those adjusting from K-1. If you get past the consular interview and get the visa granted, you're pretty much golden as long as you marry and file on time.

The AOS interview is not scary at all, most people find it very anti-climactic. It lasts maybe 10-20 minutes. They usually want to see some pictures, and some documents showing you have comingled your finances (joint bank accounts, both names on the lease, one spouse naming the other one as beneficiary to the 401k account, stuff like that). They will also observe your interaction as a couple, your body language, etc. So unless you are only pretending to be married, there is really nothing to worry about.
