November 2013 F2A Visa Bulletin Prediction

F2A Category: F2A category retrogressed in October VB by few weeks. DOS may have decided to hold dates steady to get a good estimate of demand. Hence it is possible that if enough demand have been received, they might decide to further retrogress dates.

Timeline

Hard to predict without Demand data for the last 3 months especially when F2A was current. I am hoping and praying that VB remains similar to Oct bulletin for the next 3 months at least even if dates do not move forward.

Nov VB should be out anytime now. Employment based Demand data is out for November bulletin. I wasn't able to get one for family based though. Please do post the link if you come to know about the location of the demand data up to November 2013 for family based cases.

DOS did not publish demand data for family based petitions in the past 3 months.

I stumbled upon this FB2A Visa thread via google. It is unmistakeably an invaluable source of information , first-hand accounts of applications , statuses and questions/answers. So, I am very greatful to everybody for detailing their situations and cases on here. As I sift through the jargon of NOA1's and NOA2's and AOS's and DS3032's, it truly is remarkable - how the system creates a maze of obfuscatory acronymns and un-intuitive terminology, to keep even the most well meaning and educated confused.

So - I dare put forth my question. It may very well be that, I am indeed on the wrong thread. Please bear with me. My wife is a green card holder. I am on an H1-B visa. Since the FB2A visa category became current (which I understand, is an event of extremely rare occurence and even rarer probability), I submitted my documents to the USCIS through my well-intentioned Attorney, on September 27th,2013. That is, as per my attorney - I concurrently filed my I-130 and I-485. Since then, I've encountered this thread - which talks about possible/potential retrogression of dates and the Priority date has retrogressed to 08SEP2013.

SO - If I understand this right - It means, no more visa numbers - thus, I don't get a case number since my PD is 30SEP2013 which is after the cut-off date of 08SEP2013. Secondly, since nobody knows when the date will move(30SEP2013 ) - it means, i just have to wait - could be 3 months, 6 months , 1 year. Am I right in interpreting this ?

Thats right.... we will have to wait for dates to move past our Priority Date to expect a visa number to be assigned.

On the bright side, as you were able to file AOS successfully just on the nick of time, you can expect to receive a EAD (765) and AP (131) within 60 days.... This can be your fallback status if you cannot maintain your H-visa.

09/11/2013 - Delivered to USCIS Chicago Lockbox

09/16/2013 - Acceptance Confirmation text messages (4) and emails (4).

09/17/2013 - Check cashed.

09/23/2013 - Four I-797C notice of action in mail.

09/23/2013 - I-130, I-765 and I-131 online status showing Initial Review. I-485 showing Acceptance.

09/26/2013 - I-797C for Biometrics notice. Appointment scheduled on 10/10

10/01/2013 - I-485 case status updated to RFE and the RFE notice mailed out.

10/08/2013 - RFE response mailed out.

10/10/2013 - I-485 case status changed to "RFE response review"

10/10/2013 - biometrics completed on scheduled date.

10/29/2013 - EAD card production ordered

11/07/2013 - Received combo card.

11/15/2013 - I-485 case status change to "Testing & Interview"

01/02/2014 - Received notice that interview is scheduled for Feb 3.

02/03/2014 - Interview went well. Now it is a waiting game as our dates are not current.

Waiting to receive atleast an I-130 approval

03/17/2014 - Received txt: I-130 approved.

Your I-130 will be processed and you will get a case number for your I-130 irrespective of whether the VISA bulletin is current or not. Your I-485 will also likely be processed up to a certain point. In the sense it could be "pre-adjudicated" and then all IO will be waiting for is a Immigrant VISA from DOS when your PD becomes current.

I know this for a fact when i got my I-485 processed in the Employment based category and i got a CD from USCIS with about 170 pages after submitting a FOIA request with screenshots of every department/screens in USCIS that handled my I-485.

In short words, you missed the bus. dates could move forward. F2A has a tendency to retrogress i.e dates go backward. In fact it happens every year if i am not wrong. somebody plz correct me if i am wrong. Your I-485 will not be adjudicated until your I-130 gets approved.
