My fiance had his interview yesterday, Sept 11 at 7:30AM [MNL Time], and didn't get out til about 3:30PM.

He was one of the last people to get interviewed.

Now, he was refused of the visa, because I don't make enough money, and the consul wouldn't take our co-sponsor, which is my mom. He was given a form and it said there 'Hard Refusal' with the 212(a)(4) being checked that says 'You are likely to become a public charge.'

One of my mistakes was when our HR Dept mailed me my employment ver, I didn't pay much attention due to the fact that I was sending the papers the day I received it, and it said my hourly rate because I'm only working part time and my hours vary. The consul apparently also said that they need to send the paperwork in again with more 'supporting documents'.. I am also currently working as a part-time server which makes $3/hr and no definite hrs, and I just started doing that, so I didn't get to provide an employment verification. So as of now, I don't know what to do.. my fiance's parents told me that they will make a joint bank account for him and his mom, get it notarized and get an affidavit from an atty., and submit that with the other documents that I need to get, esp. the employment ver again in per anum explanation from my court intake job and the employment ver from my serving job. They also said that they still will send my mom's co-sponsorship paperwork. My parents also suggested to write a letter saying that he will not be a public charge, due to the fact that they make more than enough to support him til we get married and adjust his status and get a job.

Well, what else is there that I would need? Any suggestions? I'm trying to send the paperwork, asap (Saturday). Please HELP us!!! sad.png

Best suggestion I have if for you two to get married, then file IR/CR-1 spousal visa, embassy has to accept co-sponsors then.

Philippines doesn't accept co-sponsors. You can try to show pay stubs instead, but if you work is variable, you might have to marry and file for a spousal visa. Then they will be forced to accept a co-sponsor.

USEM does accept co-sponsors with the K-1, but they are very fickle about it, of course with the IR/CR-1 they have to accept co-sponsors.

I have low income, yes. But I have not been on welfare. And I am a hard worker. I have been applying for decent jobs for the past two years now! It's just hard to find one. Just because you have enough income and all of that, that doesn't mean you have the right to say such things. We do not intend for him to come here and ask for any kind of help from the government. He will come here and work. We do not work around the system. Never have and never will. I don't understand why you have to come and mouth off all the unnecessary things. You don't even know me to judge me. Please leave this topic!

hey i think i saw ur fiance last day... he is familiar because guy fiance is rare only... he was refused? really...other applicants there was approved joint sponsor only... i think they need more papers.. yes ur right u need to submit papers.. the other girl i talk yesterday...she said she also need documents because her fiance dont enough money... that was the problem yesterday sept. 11 interview.. most of them are lacking of papers especially the income...ur fiance are not alone yesterday with that case...

Hmm, if this is so then what do the people who are currently unemployed do then? I would think they would have to also consider the past as well, actually I read that they view up to the last 3 years. Furthermore, how can they go by CURRENT income when the latest tax reports they can even see is LAST YEARS, 2012.... It would make sense to think that there would be an equal weight upon current income as well as the past 3 years, because one could be unemployed/struggling now (my present situation) but was much more financially stable last year, or 2011 or 2010.

Here's my suggestion for what to submit in order to overcome the public charge issue:

1). Your I-134.

2). Your 2012 income tax return.

3). Your 2012 W-2s.

4). Three months of your current paycheck stubs.

5). Employment verification letters from both of your employers.

6). Your joint sponsor's I-864.

7). Your joint sponsor's 2012 income tax return.

8). Your joint sponsor's 2012 W-2s.

9). Three months of your joint sponsor's current paycheck stubs.

10). Employment verification letter from your joint sponsor's employer.

11). A notarized letter from your joint sponsor verifying that they support your marriage and that they fully intend to financially support both of you if needed.

Even if you have already submitted some of these documents, submit them again.

12). A notarized letter from you detailing any jobs, higher education, training, or special skills you or your fiancé have which would make either of you more employable/upwardly mobile in the U.S.

My mom's documents are with my fiance. However my affidavits and my tax transcripts and all of that, was taken by the CO.

So should I just do my portion and they submit my mom's with it? My mom said she will write a letter to explain that she and her husband can provide for him if my income is not enough, so I will send that with the new paperwork.

Also, would his parents transferring money to his bank and get an affidavit from a lawyer will justify that?
