Visa REFUSED...

My fiance had his interview yesterday, Sept 11 at 7:30AM [MNL Time], and didn't get out til about 3:30PM.

He was one of the last people to get interviewed.

Now, he was refused of the visa, because I don't make enough money, and the consul wouldn't take our co-sponsor, which is my mom. He was given a form and it said there 'Hard Refusal' with the 212(a)(4) being checked that says 'You are likely to become a public charge.'

One of my mistakes was when our HR Dept mailed me my employment ver, I didn't pay much attention due to the fact that I was sending the papers the day I received it, and it said my hourly rate because I'm only working part time and my hours vary. The consul apparently also said that they need to send the paperwork in again with more 'supporting documents'.. I am also currently working as a part-time server which makes $3/hr and no definite hrs, and I just started doing that, so I didn't get to provide an employment verification. So as of now, I don't know what to do.. my fiance's parents told me that they will make a joint bank account for him and his mom, get it notarized and get an affidavit from an atty., and submit that with the other documents that I need to get, esp. the employment ver again in per anum explanation from my court intake job and the employment ver from my serving job. They also said that they still will send my mom's co-sponsorship paperwork. My parents also suggested to write a letter saying that he will not be a public charge, due to the fact that they make more than enough to support him til we get married and adjust his status and get a job.

Well, what else is there that I would need? Any suggestions? I'm trying to send the paperwork, asap (Saturday). Please HELP us!!! :(

your only option is to find another joint sponsor

I don't really have anybody else, but my stepfather.. But see, the consul didn't even look at the I-134, I-864, tax transcripts, employment verification, and my mom's paystubs. He said that they're only basing it from my income.. but it's so funny, because my friend's friend just passed the interview with a co-sponsor. unsure.png

I don't know. My fiance doesn't know either. He just told me that the Consul was rude and was acting like an a$$.

I haven't talked to fiance because after they(him and his parents) got home, he went straight to bed. His parents said he's really upset and depressed and worried that he wouldn't get a visa.

I am requesting that this topic be moved to your countries forum. because I know PI is very strict with K1 Co-sponsors. They reject them alot. And seeing they didn't even bother to see your parents papers.

Sorry about it but I am sure you will get some good help there.

I believe Manila has some history of rejecting the use of cosponsors for K-1s.

You may have to wait until you make enough incoime and file again and/or get married and file for a spousal visa.

Phil (Lockport, near Chicago) and Alla (Lobnya, near Moscow)

As of Dec 7, 2009, now Zero miles apart (literally)!

Philippines doesn't accept co-sponsors. You can try to show pay stubs instead, but if you work is variable, you might have to marry and file for a spousal visa. Then they will be forced to accept a co-sponsor.

AOS for my husband

Yeah, that's what I'm trying to do. And also get my second job's owner to get me to write the employment verification and all.

Thanks.

What's so amusing is there are a lo t of people bypassing this co-sponsor thing in the MNL Embassy. So I just don't understand. Why us? 100% bonafide relationship, then this? I don't know.. but thanks!

So I heard, but lately, the people who has the co-sponsor have been getting approved easy.

That's gonna be our last resort.. but since it wasn't a denial, hopefully everything I send this time around is enough. Thank you!

What does the case have to be in order for them to accept a co-sponsor? I've been a single mother to my fiance and I's child. And I did my best to provide that information.. and that we're trying to be a family so that we can be together and he can provide for us, because for the past two years, I did not receive a single penny from him because he was at school full time. He just graduated from college. I'm so torn right now.

But thank you for responding and listening/ reading my rant.

Case-by-case insinuates there's no hard and fast rule they're following. There's conjecture that they more likely accept if it's close family (which can't be true in your case, because you can't get much closer than your mother) or that they accept a joint sponsor when the petitioner has demonstrated that they have worked and made as much money as they can, but just fall a bit short, or that their income is set to increase in the future (demonstrably).

Search about on the forums to see what others have done:

http://www.visajourney.com/search/index.php?cx=007424365766759747816%3Auy9flr-th5y&cof=FORID%3A10&q=i-134+joint+sponsor+manila&sa=Search

It seems sometimes Manila just won't take a joint sponsor, no matter the cirumstances.
