HELP w/ I 130 Form (DCF)

I am sharing an email with JAce who recently submitted the I 130 form with great success. Hoping this can help others.

Hello,

I hope you do not mind my sending you a message with questions about the i-130 form. Your story is inspiring and you were approved quickly. I can't afford to make any errors on my I 130 as I will fly back to the USA shortly after submitting my petition abroad. I have 3 questions if you would not mind helping.

1. On your I-130 form under section B regarding address. Did you insert USA or PHILL address? I will fly to USA after submitting and would like all paperwork sent to USA so I am double checking. I am leaning towards inserting USA address since the form does not ask for 'residence' in this Section B.

2. Lastly, Section 15 asks for 'name and address of employer' is that for my information or my spouse?

3. Section 21 asks for last address where we lived together. If that is our current address what date should I insert in the 'To:' section? should I leave it blank?

Hi

I was originally going to just stay long enough to file and then leave also, but I'm staying for the process.

1. I put down my Philippines address for everything dealing with place of residence and mailing address. They may look at this while filing or during when they decide to approve or not. Also, I wouldn't count on ever receiving anything from the embassy through mail anyways when DCF. You should plan on emailing and calling them to find out approval and being proactive about completing the next steps yourself instead of waiting. The process can move very quickly and you can minimize time without your spouse this way.

2. Everything on the I-130 is from the petitioner's point of view. If you are the US citizen then you are filling it out, not your spouse. The G-325A is the only document at this stage that will be filled out from the petitioner and beneficiary's point of view. Later on, after approval the beneficiary will fill out DS forms from their point of view.

3. I put my address in the Philippines and put the time I arrived here to Present in the date section.

I hope this helps! Really though I wanted to make sure that it looked like I was permanently living in the Philippines, although I had every intention of returning back to the US. They really only like permanent residents filing so make sure you take lease contracts and every utility bill you can thank of there, and also BDO or BPI or some local bank account statements. Make copies of all of them and have extra copies of birth cert's and marriage certs. Be over prepared!

Question to successful DCF I-130- petitioners. We have been living in an apartment together since I have been visiting. For the past 2 months we have been in the same country, but a different city living with a family member. Purely to visit another region and experience the country. Should I list this address on the I-130 form or where we have been residing? Will USCIS look up our address?

Have you both been legally living in the same country for more than 6 months? Because this is generally a requirement to be able to file DCF.

As for the address, yes, you should put both addresses in the biographic informations forms, but I doubt they will look it up. They might however send you RFE (request for evidence) since you are married but have been living in different cities. This does not massively delay the process if you respond quickly to their enquiry. For the I-130, they will ask for both addresses so put both.

Also, put the address where you used to live together so they see that you had been living together in the biographic information form.

Thank you! Yes, I (the American) have been here just about 6months. I am waiting for the 181 st day to file DCF. Am printing credit card statements and preparing packet for proof of relationship since we are newly married and do not have many joint assets yet. We have 5 years of photos, receipts and letters we are photocopying and organizing while I wait to submit.

Keeping fingers crossed for us all!!

What do you mean by this? domicile and sponsorship?

when you get to nvc this comes up a lot

aos will be needed where proof that the immigrant will not become a public charge .. you or you and a co-sponsor will need to submit these.. refer to i864 instructions

domicile is addressed frequently here too.. try the advance search tool and make sure you read the guides in detail as well as all related forums related to your future processing
