Hi All, New member with a quick question if anyone can answer for me.

A month ago I married my American Wife, we had dated for about 18 months when I came down to visit her for 2 weeks we decided to get married and 6 weeks later we did. I have lived with her in NJ for about 3 months now. I entered from Canada legally and was fully checked at the border.

My question is I am starting the paperwork to get my permanent residency and was wondering about the I-485, does my Wife fill out the I-130 as well or do I just apply for the AOS?? I ask as Part 2 on the application for the I-485 is the application type and none of the boxes refer to my situation. How do I proceed??

Any help would be greatly appreciated.....

I130 is filled out as well, along with various other documents, follow this guide and check in here with your list before sending it off, its not to difficult just take your time and double/triple check everything.

Can a Canadian citizen just come over on a visit get married and adjust their status? Did OP come over on a K1 visa or visitor visa? They don't have a timeline so he may have come over on a visitor visa and married. Just curious to know

It is illegal for anyone to enter on a tourist visa with the intent to immigrate. But, if that was not the intent when the person arrived, and they are in the US, it is possible to adjust status. It seems like these people decided to get married unexpectedly.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

That's right, we dated for 18 months but had never spent more than a week together. I had a 3 week vacation so I thought I'd see what spending a longer time together felt like, t'was awesome so we decided to make it permanent.

Entered on the usual B-2?? tourist visa and will now adjust status.
