hey community,

quick question: i am currently in possession of a c1 visa (also known as crew visa for air crew staff), will this visa still be valid once i'm issued the k1? see potential trouble of getting into an argument or more with my employer.

ultimately i'm wanting to quit my job but there my be some time where both visas will have have to overlap.

any ideas?

thank you

christian

Yes, you can have both. But once you enter the US on the K-1 you will not be able to leave the country without being stuck outside it for at least a few months, until you get your approved AP. So that doesn't mix with needing to work on a plane.

Nope. People often have both C/D and B2, for example.

The two listed are non-immigrant visas. I'd think they'd cancel her C1 when she is issued K1 *marked as non-immigrant but everyone knows the intent is to marry a USC and adjust status.

It is impossible to adjust status from a C1, so it seems reasonable that her employer might want her to continue working a few more flights before officially quitting or taking leave to move to the US.

You can have C/D, H1B, B1/2 all at the same time but not with K1 or CR1.

My B1/2 was cancelled when I got CR1.

Your experience isn't necessarily the norm. People can travel on a tourist visa (usually VWP or Canadian visitor) before travelling on their K-1.

C/D mixes well with anything because there are no rights to anything associated with it. No AOS, nothing. A K-1 is good for 6 months and a person might want to tie up loose ends with their job before officially making the move to the US. C/D is special.

My husband's B2 wasn't cancelled, btw. But B2 isn't the same as C/D.

VWP is not stamped and hence it can never be cancelled.

My understanding is any non-immigrant visa applicant holds would be cancelled once they receives K1 or CR1 as on other visa they no longer can justify that they have no immigrant intent.

C might be different case as there is no AOS from C and they might not cancel it.

Yes you can.... the ultimate decision is up to the CO at the embassy.... I dont think they will cancel it as they understand you will continue to live in your country and work until you enter the US...

However, once your K1 has been issued, your next entrance into the US must be under the K1 otherwise, you might get into trouble.... but meanwhile the paperwork for the K1 is in process and everything else is going with no K1 issued yet, I am positive you can still travel....

CR1 is different than K1.... it is similar, yet a little bit different.... again, it is really up to the CO.... there´s no need for you to have a B2 if you already have a CR1....
