If you fulfill the residency requirements for the state in the U.S. where you live, you can file for divorce there even if your spouse lives in the Philippines.

I don't know how it works in countries other than the U.S., but I'm guessing that there are many countries that have a similar residency requirement.

What country are you talking about?

Are you a Filipino? If so even if you do divorce your husband while you are in another country it will not be valid in the Philippines.

Where are you planning to apply for the visa? Philippines or another country? If in the Philippines.. don't think it will work.

I am no expert on PI annulments... but I believe if you got married in the PI, and both are PI citizens, then you will have to get an annulment in the PI. I don't see how being a non-resident in HK will help you at all.

In other country (HK) and we'll get the visa processing there too...

If you are doing the visa in HK also I don't see an issue, requirement is each person being free to marry, a divorce decree shows that. Not applying in the Philippines avoids the CENOMAR requirement.

Of course you have a potential problem if you ever travel back to the Phils without getting an annulment.
