Wanted to thank you all VJ people. That's help me a lot when I was filing my green card in 2011.

Now situation changed and I got divorce in February 2013 and Now here I am to file for removing condition on my green card.

I screw up by not filling it so soon and Now by green card going to be expire in October 2013 first week.

I have Prepared all documents and about to send it in couple days. But now I am nervous that if anything goes wrong then I don't have any time to fix that.

Can you guys please take a look?

Are those evidence enough?

Is there anything I am missing?

Here is my cover letter.....

5) Copy of Permanent Resident Card

6) Copy of my foreign passport (front and back)

8) Copy of marriage certificate

9) Copy of Divorce Decree

10) Copy of a letter for “Life Insurance Policy” showing Spouse as beneficiary.

18) 2012 Tax return.

19) Combine Checking Account’s Statement.

20) Combine credit card’s Statement.

Just so you know, you were required to file RoC immediately after the divorce. You are 7 months late at this point.

No I guess because I asked here in forum and I also ask attorney about when should I file and they said that It's preferable as soon as divorce final but You can file anytime until your green card expire. And My green card is not expired yet.

I could be wrong but can someone please verify this if anyone was in this situation.

Anything would be appreciated.....

While you CAN wait, you are in breach of the conditions of your conditional GC by being divorced. You should have filed as soon as the divorce was final, or during the 90 days (whichever came first). As your divorce was final in Feb 2013 you should have filed then, but it doesn't mean you can't now or that you will be penalised by USCIS for filing after then.

The reason the "breach of the conditions" part is important is because well, you're breaking the rules and could get into trouble if caught before you file for ROC. Likely? No, not likely at all. But still possible... which is why you should have filed ASAP.

Don't stress now though, file as soon as you can (and before the card expires).

Are these documents I have is enough? Am I missing anything important here?

I am afraid that if for some reason, my application get rejected then I don't have window to reapply and my green card will expire by then.

As long as the form is correctly completed (and signed... you wouldn't believe how often people forget to sign) and the check is correct then it will be accepted.

The other documents (evidence of relationship) determine if it will be approved or not. Your evidence looks good to me. It will take several months so just be aware of that. Make sure you include documents spanning the length of your marriage... so a few bank statements, not just one (unless there is only one).

So Now I got my I-751 recipe and it's stated that extension is for a year or untill GC not terminated. I also get letter for biometric which I have on 18th of this month. I wanted to travell abroad for 3 weeks after my biometric done but I am afraid that If decision was made while I am not in country or they ask for something while I am not in country, What will happen?

What's the normal processing time?

Am I allow to come back to country for apeal?

Just got email from USCIS stated below...

Application Type: CRI89 , PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED


Your Case Status: Card/ Document Production


On December 24, 2013, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283.


This step applies to applications that result in an applicant receiving a card (such as a "green card") or other document (such as a naturalization certificate, employment authorization document, travel document, or advance parole). Applications will be in this step from the time the order to produce the card/document is given until the card/document is produced and mailed to the applicant. You can expect to receive your card/document within 30 days of the approval of your application.


Is this mean, I got approval and got green card?

If that's true, I really got amazing Christmas gift today.

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
