Switch from Consulate Processing to AOS

Hi there,

My 2.5 year old daughter and I are at the end stages of Consulate Processing. We both have approved I-130's and verbal case completes with the NVC. The issue is that it's taken a tad longer than anticipated to get this done, and she is visiting my wife in the US right now. My question is, if we were to switch to AOS for her only at this stage, is it as in-depth as I am reading on the USCIS website? We have already been through the I-864 and all the other support documents that have been accepted by the NVC.

Does anyone know what is involved with doing this change? Would I have to only advise the NVC of the change and submit the I-485 along with fees to change process direction? At her age, biometrics is not needed, and the medical can be done in the US upon request of the USCIS.

Any help would be great.

Why would you want to pay $1070 now when you could just wait a month or so and save that money?

Due to the timing, my wife (the petitioner) is not able to fly back with her and get it done. She's in school full-time and has a huge workload.

She's only 2.5 and does not require work authorization or anything of the sort, so we figure it may be easier and less disruptive to everything to get the AOS done.

But aren't you in Canada also waiting for interview scheduling? The USC doesn't need to go to Canada.

If you want to do it you will have to send a copy of the approved I-130 notice along with the I-485. You will need a US medical and you will have to redo all of the financials.

You may have to pay extra to file a form to request action on a case because your file is on its way to Canada and is with DOS not USCIS any more. I can't think of the form number right now to see if this qualifies.

My daughter is in the US with my wife right now.

I dont mind paying the additional fees. I just want to make sure it all gets done in one shot.
