I have a NOA2 of July 26th and the Approval expires on November 25th 2013. It took one month for NVC to receive my approved petition, and It has been there for over two weeks, according to them under administrative processing...

Basically I have two months before this approval expires. If the consulate at Santo Domingo is scheduling interviews for December and January 2014 at this point, what should be done? I don't want to go there to the interview with my fiancé and voila!!! Your petition is no longer valid!

Any ideas of what to expect or what could be done in case it expires before the interview date?

This thing is a hassle from front to tail... Ughhhh! protest6wz.gif

The Embassy has the ability to re-validate the petition if an interview has not taken place by the expiration date listed on your approval notice. Re-validation of petitions is common and routine; plus, no action on your part is needed in order for this to happen.

Do not worry about this date, it ultimately will not be an issue.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

This is great news.

My NOA2 expires on 11/24 and the interview is not until 12/10.

Finally, something they can do without action on our part.

IN the K-1 proces, the NOA2 "experiation" date is meaningless. As long as NVC or the Embassy has the case, it is automatically extended. There is nothing for you to do and nothing to be worried about.

My fiance and I are currently in the process of doing a k1 visa from Argentina to the U.S. Unfortunately, due to some set backs, we find ourselves in a predicament.

Today is January 4th and our (approved) I-129F petition will expire on the 11th of January; however, my fiance has not been contacted by the Argentine embassy with information regarding his interview appointment. Thus, it is likely our I-129F petition will expire before he has an interview.

We have sent all necessary copied documents to the consulate, but unfortunately, my fiance sent them in right before Christmas and New Years. We tried to avoid sending them in so close to the holiday, but my documents from the U.S. (I-134 + evidence) was held up in the Mendocina Customs agency due to some strike that occured in the summer, which in turn caused a backlog in mail processing in Mendoza, where my fiance lives (15-18 hours from the buenos aires where the embassy is located). In any case, the embassy should have recieved our packet the day before Christmas Eve.

My questions are:

1.What happens if the petition expires before an interview is scheduled? (for the U.S. consulate in Argentina)

Oddly enough, we have an immigration lawyer that I hired in the U.S., but he informed me that my fiance should make the interview appointment himself, yet, our instruction packet suggests that we are to wait for the embassy to contact us about a date.

2. Is my lawyer correct? K1 visa petitioners in Argentina should schedule the interview themselves?

3. If the above is indeed accurate, how?

4. Bottom line, if anyone has any idea on how to proceed if he or she were to be in my situation, I would greatly appreciate your advice!

Whew! I had the same question and was so thankful to find this answer today. Our NOA-2 says it expires Feb 4, 2014. I have been freaking out because we have run into issues on the Haitian side of things with renewing my Fiancé's passport. It has been taking 9 months to get his new passport and we need it for the medical exam and in order to turn the packet back into the embassy to get our interview date! Wish us luck that we make some progress soon! I'm so thankful for the answers VJ has helped us with so far.

02-08-2013: I-129F NOA1 received at Vermont Service Center.

06-21-2013: Received email notice of petition being transferred to local office.

06-28-2013: Received paper copy of notice of transfer to Texas Service Center

09-10-2013: Received email notice of RFE.

09-14-2013: Received paper copy of RFE.

09-27-2013: Texas Service Center received evidence for RFE

10-2-2013: Received email notice of NOA2

11-05-2013: NVC received petition.

11-13-2013: Haiti Embassy received petition

11-19-2013: Packet 3 sent from embassy (never physically received because fiancé had changed addresses and Embassy didn't have the right one)

11-20-2013: Address officially changed, Electronic copy of Packet 3 received via Email.

1-22-2014: Email sent to Haiti Embassy requesting Visa Petition Extension (Petition expired 02-01-2014)

02-10-2014: Visa Petition Extension granted via email response from Haiti Embassy (we were delayed turning in Packet 3 due to issues renewing Fiancé's passport and getting new birth certificate from Haiti Archives!)

02-28-2014: Packet 3 submitted to Haiti Messenger

Whew! I had the same question and was so thankful to find this answer today. Our NOA-2 says it expires Feb 4, 2014. this post was very helpful. i had to cancel my interview for today because my passport was stolen with my other documents...had to reschedule and only available date was in september, only our petition was to expire on 28th August so I was really freaking out...but now I can relax. Thanks for sharing. ..

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
