Expired I-94 what to do?? HELP!

here it goes:

married last 31st of August and MC will be okay end of this week. and the thing is my k2's i-94 and mine will be expire on Sept 18.. we wanna get ssn. What to do please help me I'm so confused with others telling me that we cannot get ssn until we file for aos and receive our gcs..

I'm afraid that you have left it too late to get your SSN now. There has to be at least 14 days validity left on your I-94 for you to get your SSN. You will have to wait for your EAD now.

Although you may go to a SSA office where they are not well trained and don't that you should have 14 days left.

Agreed, I also doubt you will get a SSN until after you file AOS/EAD. My experience with the SSN office is that they are "lacking" knowledge on K type immigrants. I had to point out my K1 fiancee (now asawa!) was in fact eligible for an SSN when they said she was not. 45 minutes later we walked out with a completed application and pending SSN.

You may be very lucky and have them process your application.

There are numerous links/posts here on VJ concerning when to get a SSN along with proper timeframes for K visa immigrants.

You cannot get your SSN now You needed to have at least 2 weeks left before your I-94 expires. You must wait until you file for AOS and get your EAD. The K-2 had to wait for the EAD anyway.

No. A K-1 entrant does not automatically get an SSN. You must go to the SSA and apply for it. The DS-230 part 2 does not apply to KI-1 applicants. Even those entering with a spousal visa have to sometimes go in person to apply because they never receive theirs.

It is the 9th... too late. You need at least 10 days remaining on the I-94 to apply for the SSN. (BTW you do not need a marriage certificate to apply for the SSN)

Apply for AOS, include the I-765 & I-131, both are free to file when accompanying the I-485. Normally you will get the EAD in about 2-4 months, with that you can go apply for your SSN. Don't need to wait for the green card.

Went to SS office today and the guy told me that he can't give me the ss# today and I should go back on 19th (i-94 expires on 18th) so, I should go back on 19th to process that and give him my passport and bc, he didn't tell me to bring my mc so does that mean he'll give ss# on my single name? even if I already married my fiance?

Should I go back on 19th?

and concern number 2 is: my k2, he told me to apply my k2 an ead before he can process the ss# application of my k2 (which is only 7y.o) I am confused before why my child needs ead if she's still minor??

Is the guy I talked to earlier gave me the right advice and instructions?

If you return on the 19th, they will tell you the I-94 is expired and they cannot give you one, You need to apply for AOS, at which time you will also apply for the EAD/AP. When you get your EAD, you can go apply for the SSN. A K-2 is not eligible for an SSN before getting an EAD or green card. Yes a child can apply for an EAD just to be able to get the SSN.

yeah coz I was so busy for wedding preparations.. my F (that time) does not know where or who to talk to about weddings.. I already did some reading about aos but a little bit and I just take step by step at a time..
