Hey guys,

Okay, after a yr of USCIS not sending us the RFE (they would tell us they sent it, and they never would), and after we finally got the RFE/responded to it thru the congressman in November 05, we finally received 3 wks ago, a letter telling me to go do another biometrics (it has been 17mths) next week.

Just yesterday, we finally received a letter to appear for an interview beginning april.

1) Has anyone been approved automatically w/o interview after doing their second set of biometrics, even though they also received an interview letter?

2) Does EVERY couple that's been married for less than 2 yrs and they get an interview, automatically get a 2YR CONDITIONAL GREENCARD? Why do they have conditionals anyway?

I dont know anything about your first question, but i do know that they give conditional 2 yr green cards to be certain that the marriage is valid.. (this is usually done for the marriage based ones obviously..) Maybe if you are close enough to your 2 year anniversary they might give you an unconditional one.. I dont know... Good luck!

Yes. The law was written very specifically about this. The theory is that before giving the immigrant a lifelong pass to live in the US, based on marriage to a USC, make sure this is a genuine marriage and not one netered into solely for immigration benefits.

Please read about conditions on Permanent Residence here:

Now That You Are A Permanent Resident

http://uscis.gov/graphics/howdoi/PermRes.htm

"Some of you may be CONDITIONAL RESIDENTS. This page applies equally to you while you are in conditional resident status. The difference between you and an unconditioned permanent resident is that your permanent resident status will expire in two years from when it was given, unless you successfully petition to have the condition removed. Those of you with conditional permanent residence either received your residence through a marriage relationship where the marriage was less than two years old at the time you became a Permanent Resident, (more)"

How Do I Remove the Conditions on Permanent Residence Based on Marriage?

http://uscis.gov/graphics/howdoi/remcond.htm

Background

"A lawful permanent resident is given the privilege of living and working in the United States permanently. Your permanent residence status will be conditional if it is based on a marriage that was less than two years old on the day you were given permanent residence. You are given conditional resident status on the day you are lawfully admitted to the United States on an immigrant visa or receive adjustment of status. Your permanent resident status is conditional, because you must prove that you did not get married to evade the immigration laws of the United States."

The portions of law covering this are quoted in these 2 pages, with links to access them.
