k-1 ? or not? London or Pakistan?

I'd recommend filing the CR-1. That is a marriage according to Islamic custom. With the large number of Muslims in the UK, I highly doubt the embassy will be unaware of such customs or anything. But this is irrelevant as his visa expires in April of 2014. He will finish this process at home.

If you try and file the K-1, while concealing that you are married, yes even with that little white paper, it could constitute fraud and it's not worth the risk. Get a letter of attestation from the Imam if you must to accompany that little white paper. When he goes back to Pakistan, by Islamic law, he will be considered married. Pakistani petitioners already suffer severely long AP waits. Don't gamble with anything else that might slow down the process.

And that temporary marriage mentioned above wouldn't get any marriage benefits except the one that they obtain this form of marriage for in the first place....

So we should all know it's definitely not that.

Thank you for your valuable advice Boiler, MidUvil and joaozino. I think I may just be hiring a lawyer instead of attempting this on my own.... I suppose we could get the marriage attested and made to be recognized and then file cr-1 .... but we have a daughter and me and her are both missing daddy.

We stayed in London for the allowed 6 months, and since uk doesn't recognize our marriage we cannot join him on his education visa. Its one reason why we are opting to get the nikah attested by ministry of foreign affairs in Pakistan, so that hopefully we can at least go to Pakistan (without visa) obtain the id cards and stay with his family there until we can figure this mess out.

and by the way, I just want to mention I am firmly against 'nikah mutah' it has nothing to do with my situation and to the poster of that one... I think you must seek advice from someone with greater knowledge and understanding of not only marriage, shariah and visa..... but the all knower. Thank you

You can get married in the UK, just need the appropriate visa.

im kind of fed up with uk ,as I (and daughter) was deported from uk the first time I went to visit my husband (fiancé) however you are looking at it)..so many hoops to jump through and technicalities .. Yes I think I could obtain the visa to marry him easily being usc.... But I am not sure if he is legally able to marry in uk on student visa?

The answer is yes, as long as he's legaly in UK so hes free to marry

Im just curious how long that process would take.... Appply for marriage visa for uk, get legally married there, then apply for cr-1.... However his student visa for uk expires in april 2014 by then , we might as well just be in Pakistan for any interview?, or........ our marriage will be recognized in pak and we can apply cr-1???. Ughhh im very confused, and I just want to be with him soon. Patience is one of my worst subjects in character and I think we may be spending 2 or 3 000 and just get a lawyer. my brain cannot compute this.

but y not try in uk with this nikah nama? tell your hubby to call Local Register office in lodon where hes residing nd have them this Nikah nama to register it in their system nd maybe thn they will issue him the official MC? Dont higher a lawyer it wont help you n any way

@@mirPearl He cant just get it registered there... I was on tourist visa (not allowed to marry) I would need to get the proper visa, apply for a permission to marry, and get it done by registrar, then start any cr-1 process

September 2012: Filed from abroad to Chicago Lockbox

4 days later: NOA1, Routed to California Service Center

7 days later: Transferred because of new jurisdiction

5 days later: Case Status changed to: Under processing at USCIS office

NOA2 arrived 78 days after NOA1 :)

*I-130 Approval Notice hardcopy finally received in Pakistan, the only notice that arrived.

My fiance is a Pakistani Citizen, but he lives in London right now on a visa for school and has been there for 2 years. We met there while I was on a vacation to London and we had a religious marriage ceremony... (Islamic Marriage) The marriage was not filed at any official office, or stamped by any embassy. However we have now sent the marriage certificate to Pakistan (to his father) and he is getting it attested by the Ministry of foreign affairs. My first question is will they consider us married and we will have to file the spousal visa.. or is k-1 ok since it was a religious marriage?? Second question is; I am confused, If it is ok that we file the k-1 visa and my fiancé will be able to have his correspondence take place at the US embassy in UK? Or if he needs to travel back to Pakistan (since its his place of citizenship) before they will even process our k-1 petition?

You shud file for I-29F since you are not married officialy in uk and they dont have record either. If i was you i would'veapply for I-29f isntead of wasting time for nothing
