I recently married a USC and am applying for my visa.

I converted to Hinduism a few years back and am opposed to receiving the expected course of vaccinations on religious grounds.

Does anyone have experience of the waiver process? I believe that I have to refuse the vaccinations at the medical interview and then apply for a waiver of ineligibilities on religious grounds (Form I-601)

I'd like to know

  • if, after the medical interview, which I suppose I won't 'pass', and thus won't get my K3, this will prevent me and my child travelling to see my husband at all!
  • roughly how long the I-601 may take to be processed.
  • if anyone knows of success stories with the I-601 process on this issue

i have never heard of an approved waiver, their typical stance is that they are for the protection of the US people and that if you don't wish to comply than you don't get the privilege to immigration to the US. IF you want to attempt a waiver make sure to submit a well documented request. DO NOT assume that all you need to do is to submit the form

Do you think this ultimately leaves me with this choice - delay my emigration while the probably futile I-601 process goes ahead, or accept the course of vaccinations against my religious beliefs?

If my visa application is deemed ineligible on medical grounds, will I be left unable to visit my husband in the US, or will I be able to enter, on my UK passport, as a visitor?

I'd been hoping for my child to join me there next summer and start school in the USA!

I am a Hindu as well but I have never read/heard about a connection between a vaccination and a religion.

Well, some vaccinations contain the cells of diseased animals, including including cows, monkeys and pigs.

The rubella vaccine virus is cultured in human cell-line cultures, and some of these cell lines originate from aborted babies.

I really don't want to get into the pro/anti vaccination argument, I accept there are many who think a position which rejects immunisations on any grounds is wrong from a general population control perspective. I'm after immigration advice here, not a discussion on my religious interpretations and choices.

I would advise you to take the vaccines, and the other thing... if you just recently convert into your religion... did you had the immunizations before???? Maybe you have the record of some of them already??? The same with your kids... they need to be vaccinated too....

I'll assume the OP already read this:

Q. What will happen if I refuse to receive one or all of the required vaccines?
A. Tell the civil surgeon if you do not wish to receive the required vaccines or a particular vaccine. You should also tell the civil surgeon the reason you do not wish to receive the vaccine(s). In this case, a waiver may be available to you, but only under the following circumstances:

  • You are opposed to vaccinations in any form– that is, you cannot obtain a waiver based on an objection only as to one vaccination
  • Your objection must be based on religious beliefs or moral convictions; and
  • The religious or moral beliefs must be sincere.

The form used to apply for a waiver depends on the adjustment category under which you are seeking legal permanent residence status. For example, refugees and asylees seeking adjustment of status should file Form I-602, Application by Refugee for Waiver of Grounds of Excludability. Individuals seeking adjustment of status as a result of an approved Form I-130, Petition for Alien Relative, or Form I-140, Immigrant Petition for Alien Worker, would file Form I-601, Application for Waiver of Grounds of Inadmissibility.

I suggest contacting a member called Daca. This individual was able to successfully get the vaccination waiver.

I succeeded in having i601 immunization waiver on moral/religious grounds approved for my family of 4.

It's a simple (albeit expensive) process which is well established. As long as you adhere to the process the same as you would in any other part of your application, there is no reason to think you won't be approved.

Contrary to many opinions, it is not arbitrary, or even open to choice on the part of your uscis document reviewer. As long as the conditions are met, like all other parts of the process, approval will be granted.
