I'd appreciate your advice/assistance guys please

I received RFA in June 21 requesting a joint-sponsor for I-485 because my wife is not making enough as per their requirement, we have not been able to find a joint-sponsor except one who's still slightly below the 125% guideline.

What do you think we can do??? The RFA gave us 87 days to respond which ends next week on Sept 16!

Can we ask for extension to find a joint-sponsor? Should we go ahead with what we got and see what happens?

In case we missed the time and the AOS was denied, can we petition that? Would we have to pay additional fee?

I really appreciate your advice

Thanks

There is nothing you can do except find a suitable joint sponsor. If you don't make the deadline you will be denied. You can refile after that, but you waste your money that way.

Don't send in a joint sponsor that doesn't qualify. That would be foolish.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

You do not have a profile, depending on how you are filing depends on your options. IF you filed from VWP you have no rights to appeal, if you are adjusting you could try but it will be denied because they correctly denied you for failing to correctly respond in the time given

This will not be over quickly. You will not enjoy this.

Maybe the joint sponsor can make up the difference between his/her income and the requirement in assets? (Must show s/he has assets equal to 3x the missing income)

Spouse-based AOS from out-of-status H-1B, May - Aug 2012

Removal of conditions, Aug - Nov 2014

Thanks guys for your response,

If we failed to respond to the RFE on time and got denied, would the denial be for the whole package? Or only for I-485 (since the RFE is only about the I-485)?? Can we then file again for I-485 or is it the whole package again?

I believe I will be in removal procedures if I got denied, right??! Would that affect my re-filing??

I am so confused!!!
