Timeline

My wife arrived here on a K-1 Fiancee Visa, we were married on November 5, 2006. After our wedding my wife went and applied for a Social Security card, the card came in today's mail with the following statement on it:

"VALID FOR WORK ONLY WITH DHS AUTHORIZATION."

Why didn't she recieve the first type of card without this restriction?

1. The card most people have shows your name and Social Security number and lets you work without restriction. We issue this card to:

U.S. citizens, or

people who are lawfully admitted to the U.S. for permanent residence, or who have permission from the Department of Homeland Security (DHS) to work permanently in the U.S.

2006-08-22 Waiting patiently for Packet #4 to arrive, bring my soulmate to my open arms!!!

2006-08-25 Packet #4 sent out from the U.S. Consulate, in transit to my baby!!!

2006-08-29 11:25pm Email from the U.S. Consulate, the interview date is October 17th!

2006-09-29 Medical examination for Xiang and our daughter Qi. Interview is just around the corner!

2006-10-16 11:15pm VISA APPROVED!!!!

2006-10-29 Xiang and Qi arrived in Detroit, immigrations 2 1/2 hours, finally holding my sweetheart in my arms.

2006-11-05 Exchanging our vows, what a beautiful day for our wedding!

While a k-1 is employment authorized (EA), you need an employment authorization document (EAD) for her to work. This would include the temporary stamp provided at the POE or approval of an I-765 from the DHS

Wont be able to get one until she is a Legal Permanent Resident (LPR) Green card holder. After she gets the green card after AOS then visit the SSA office to have that removed.

This is my own idea in this case:

Usually K1 visa holder could apply SS card in her maiden name after 2 weeks she arrived in US and/or could have SS card in her marriage name after being married "BUT" with restriction like that because the "DHS authorization" refers to EAD card (which is permit to work). Also she could have unrestricted SS card if she's already a permanent resident.

In my case for example, i didn't rush to get SS card in maiden or married name until i got my Greencard. So as to speak last monday i'd applied SS card on my married name and surely i will got unrestricted SS card soon.

Your wife could have unrestricted SScard only after she got EAD card and/or greencard, and you need to send back her SScard to SSA office to cancel the restriction.

If you have EAD you have that restriction on your SS card....that won't be removed until you have a Green card.

There is no age restriction on a SS card - the sooner the better I would think.

How do I get my child a Social Security number?

It is a good idea to get the number when your child is born. You can apply for a Social Security number for your baby when you apply for your baby’s birth certificate. We will mail the Social Security card to you. Or, you can wait and apply at any Social Security office, but you will have to provide proof of age, identity and U.S. citizenship for your child and proof of your identity.

In addition, if your child is age 12 or older and needs to apply for an original number, he or she must have an in-person interview. If your child, age 12 or older was born in the United States, he or she must explain why he or she does not already have a Social Security number.

There may be no age restriction for getting a SS card, but there is the need for an alien to be employment authorized. Getting EAD for a child who doesn't otherwise need to be EA is an expensive way to get a SS card that the child also doesn't really need. The child can easily wait until they have become a LPR to get their SS number and card.

You apparently missed a critical word in the section that you bolded - "permission ... to work permanently". Your wife does not have that yet.

You can download the W-7 there, you simply attach it to your tax return - for my son's identification we used his report card and birth certificate as identification (if your child has a passport that would be perfect).

We brought the W-7 along with the tax return to an IRS service center and they reviewed it and verified the id right there. They also have copies of the W-7 at the service center and will assist you with filing them out if needed.

Should be done before

in my experience (filing on behalf of several clients) you file with your tax return. if you it before, it will most likely be returned requesting proof that an ITIN is required. they used to issue them without a taxreturn, but the past few years I've filed them w/ and it was received rather quickly (for the IRS ;) )
