Hi Everyone,

I'm new here but I am in a bit of a rush as i just realized yesterday I may be affected very negatively by the cut off in visa numbers for F2A category expected in October!

My husband is a LPR and we have been married since August 2010.
We filed the I130 on Sept 2012 and got NOA2 July 2013.

Now, since the visa numbers are current can i enter the US on my valid B2 visa before the end of September and adjust status?

Or is that considered visa fraud?

If so, should i announce my intent to the officer at the POE?

P.S. i sent an email to NVC yesterday asking if it was possible to do so, not realizing that this might be illegal!

As earlier post said, that would be fraud. If you told the CBP officer your intent, though you would not be lying they would not allow you over due to immigrant intent with a B-2 visa which is not intended for immigrant intent but to visit.
