I was just wondering......after your fiancé comes to the states and receives their SSN, can you claim him/her as a dependent on your taxes this year??????

Um, after you get married you file jointly. That's better than having a dependent

File jointly even if he isn't working( when he first arrives)? I thought you would be able to claim him/ her

I was just wondering......after your fiancé comes to the states and receives their SSN, can you claim him/her as a dependent on your taxes this year??????

Can never claim a fiancé on your income tax, only your spouse, have to be legally married. With immigration via marriage, she would need either an EAD or green card first before she can apply for an SS card. And before she can get those, have to married first and complete the AOS stage.

At least from my experience, couldn't even add my wife to my bank accounts until she received her probationary SS card, thanks to the APA. Telling them, this is only a 500 buck account, not 25 million didn't work either.

If you get married near the end of the year, can add her as an exemption for the entire tax year on a joint tax return. And to add her to your joint tax return, don't even need an SS card for her. But without that EAD or green card, she can't even work until she gets it.

Babies are dependents, but even if you are in the 30% tax bracket, that is only $2.85 per day less you will pay in taxes. Try and raise a kid for $2.85 per day. If in the 10% bracket, That's 95 cents per day, barely a down payment on a diaper.

yeah you can apply for SS after 2weeks when your file is in their system, they will ask your Fiance to show them your I-94 and passport.. We applied for SS before we filed AOS

Technically you can claim anyone in your household that has lived with you the entire year as long as they made under the $3,400 for the year and you provided more than 50% of their support.

Take a look on the tax sites and it'll give you more info. Here's a quick one that I pulled up. https://turbotax.intuit.com/tax-tools/tax-tips/Family/Can-I-Claim-a-Boyfriend-Girlfriend-As-a-Dependent-on-Income-Taxes--/INF14242.html

I'm not sure if in your case that he'll have been living with you long enough by the time you file to claim. I know in the case of children they just have to live with you more than 6 months of the year to claim them. Ask a tax professional or just check out H&R block type websites.

If you’re filing a separate return, you may claim the exemption for your spouse only if they had no gross income, are not filing a joint return, and were not the dependent of another taxpayer."

OP> You will file married jointly or separately. You can file jointly even if one spouse has no income. This is common for a marriage where one spouse stays home with the kids while the other works outside the home.

I'm aware that you can't claim a spouse. She was asking if she could claim her fiance before they got married at the end of the year. I was just trying to state that you can technically claim anyone living with you if they meet those requirements but it won't work in her time frame since her fiance not have lived with her enough in 2013 to be claimed.

To be honest, I wasn't thinking about this and how it would relate to immigration...how her fiancé wouldn't be a fiancé for more than 90 days here etc..

I was just responding as a normal tax question.sorry :-P
