K1 Approved: Questions about AOS and Change of address. Living Apart for 1.5 months in the US.

Hello everyone, we just received our K1 visa in the mail this week! However we have a few questions about the AOS and change of address during the processing time.

Here is the situation. My fiance will arrive in the US with me on September 30th. We will be married immediately the first week of October in California with my pastor. However, we are planning a wedding ceremony in Minnesota to be closer to my family our friends living there. This wedding will be at the end of November. So after we get married the first week of October, my fiance will then travel to Minnesota to plan our wedding. We will be living apart for the time until our wedding, about a month and a half. During this time I will file Adjustment of Status for her.

Are there any potential problems with living apart until our actual wedding ceremony in November? After our wedding, we will move in together into a new apartment in California.

Do I have to file change of address AR-11, or online, everywhere she goes?

Here are the places she will be living. First, when she arrives, she will be at the address on the K1 Visa. Then she will move to Minnesota with my family. Then after the wedding we will move into a new address together.

I just want to be careful that we dont do anything wrong.

November 2011: Started dating
December 2011: He came to Brazil - 1st time
August 18, 2012: Got Engaged
January 09, 2013: Sent I129F Petition.
January 18, 2013: Received NOA1.
June 03, 2013: Received NOA2
June 24, 2013: Case Number from NVC
August 27, 2013: Interview Date
September 4, 2013: Visa in hand! =)
September 30, 2013: The glorious arrival into the US!

October 5, 2013: Married

October 26, 2013: File Adjustment of Status

November 24, 2013: Wedding Day!

January 3, 2014: Received EAD w/Travel Permit

May 5, 2014: Green Card approved and mailed

March 9, 2016: Filed I-751 Removal of Conditions

Just relax. Use your address as her address and if you move notify USCIS of the new address. Make sure when you move to notify the post office and put her maiden name in your mail box because her green card will arrive in that name.

Also, you have raised another question about the Adjustment of Status that I have. Do I file everything in her maiden name? Or in her new name after having married me?

If you want you can report all those addresses but you may be very sorry later when the docs you wait for are either sent from place to place or lost. The answer I gave you is clear.

File the docs in whatever legal name she has at that time. Keep in mind her green card will be issued in that name.

Her green card will only come in the maiden name if that is the name you apply with. Don't apply in the maiden name if she is planning to change her name to yours. If she is taking your name after marriage, then you will put her new married name on all the AOS forms so her EAD/AP and green card come in her married name that she will use after marrying you. It is costly to get the green card changed after the fact, so make sure to apply in the name she wants to go by after marriage.

As for the address, put the address on the AOS forms that you will be living at in order to receive the notices from USCIS about your case. If you know the address of the place you will live in California, then use that. Perhaps wait to file to the AOS until after the wedding in Minnesota and you are already in CA. Then there will be no change of address of needed and all the mail will come to where you currently live in CA without interruptions or problems. You cannot really file her AOS for her anyway, She has to sign all the forms, except for the I-864 that you supply.

When you apply for AOS, she will get an NOA receipt notice and then a letter to get her biometrics done. The place she goes for the biometrics will be the local USCIS office based on the address you file with. So again, you may wish to wait a little bit and file with your final CA address.

I would say put your constant address on the mail. When me and my husband filed for my visa or AOS we put his families address, because we are renting and we could move from one place to another.

Why would the green card arrive in her maiden name? If she puts her NEW legal name on the I-485, which is her married name, that is what will be on the green card.
